hey everybody, my name is kalpesh i been coming to this site since i filled my i-130 back in december 22 2006 iam still waiting for my apporval noa 2. this site been great with all the information and detail about going thru this process i didnt post anything bescuase i just hoped that i would get apporved like everybody else . but now its just been waitin and hoping and lots fo pain and torture and i dont know what to do anymore. if anybody has any suggestion or input would really great.i don't know is it because i didnt filled I-129f or is it something else , how long is it still going to take . should i still fill the 129f or should i just wait and see..iam getting just deseprate and loosing my mind.. can anybody helppppppp :(

There's really nothing you can do to speed things up. I would not file an I-129F six months after filing the I-130. It would be a fluke for it to catch up. The time to do that was January.

Hi KalP,

is it possible she told you that you should have received an RFE?

If so, you do need to find out and to respond to this RFE. Then you should get your NOA2 within weeks.

I would not discard the idea of filing I-129F just yet. But you need to find what is going on with your case.

have your USC spouse call uscis for an update on the case (or you can call thru skype or something) you definitely should have gotten an RFE (request for evidence) by now..

and you might want to get a senator to follow up on the case in the states.

don't just mail the I129f to uscis. You should only mail them stuff WHEN they ask for it.. that way there'll be the cover letter that states what they asked you for and what you're submitting and case number so that it actually gets to your file.

I bought the book by IIona Bray "Fiance and Marriage Visas" and it says as soon as you get your first notice of action (I-797C) to file your I-129F paperwork. I have found that it is so important to read and read and read the instructions. I just came back from getting married in Argentina and had to send the g-325a paperwork back to my wife to fill out before I can send our I-130 paperwork in... shishhhhhhhh I may be wrong about having to wait till you get the notice but I really doubt it. Oh also... Don't forget to get all 8 of the g-325a signed. Send the other set with the I-130 paperwork. (BOTH OF YOUR SETS) Don't photocopy the originals and take a chance. Any other suggestions anyone---> Please!!! We need all the help we can get!!! John and Nora

hey guy thanks for quick reply. this been really though for me and my wife . i don't even know what to tel her anymore.

regarding the RFE i don't know if it it was RFE she was talking about but she said that they mailed letter regardeing eveidence of support on 5/7/2007 iwent there on 5/9/2007 i asked her to repeat my home address and she even read it off the computer i dunoo where she was looking then ijust l left i mean i asked if i can talk to anybody else or i can call anywhere she just said there nothing they can do till they get paper from uscis. now only thing werid about that was that when i came home and checked online it showed that iwas tocuhed on 5/8/2007. so how do i find out more information

do you mean that my wife should call embessy in india and ask for information. using my reciept number

i really looking to call the senator or somebody but icant find the information or number can you give me any link how do i find senator office address or number im in neew jersey btw i been checking the website but i cant find the number

so checked with uscis lady basically ignored anything i have to say and just keep giving timeline speech.aslo called the number and didnt get anything new. basically wait and see deal.there isnt anything they send me or nothing they need i ask lady clearly . idunoo what to do now .i think my case is at hault and its gonna be long time before anything happens.its good to see everybody getting atleast touches. i have nothing to go on ..stil would be helpfull if anybody can tell if i should stil file the 129f

I can tell you this much - if you haven't submitted an I-129f petition then you aren't working on a K3 visa. If all you've submitted is an I-130 petition then you are working towards an immigrant visa.

My opinion is that if money isn't an issue go ahead and file the 129F. If we got our NOA1 tomorrow I would still file a 129F. I understand why people would say not to, but there are others on this site who are together now who wouldn't have been if they relied soley on the I-130.

It sounds to my like you have missed a RFE - request for evidence. That is probably what she was talking about when she said they mailed a letter regarding evidence of support on May 7. It is a very big problem that you haven't received it or been able to respond to it. You are usually given 90 days to reply with the evidence they've requested - sometimes it is as simple as a missing signature.

Your post has been moved because you are currently in the process of applying for an immigrant visa - CR1 or IR1. I would not file the I-129f at this point - it would be a waste of money in my opinion. It would only have gained you a few months of time if you had filed for it back when you received NOA1 for the I-130.

Have you checked the case on-line, register at USCIS, and maybe you can findout what has been sent to you, you can also register for e-mail updates here, they usually come before the snail mail copies. There have been many cases of people not receiving the NOA's, so maybe you have been approved and sent to the NVC already, you could call them also! They are friendly and helpful, I am not sure but I think they can look up your case if it has been sent to them. IMO I-129F won't help you, save your money!
