December 2019 I-129F (K1) Filers

Timeline

I have yet another question. The RFE mentions a disorderly conduct charge. Then asks to provide court docs/police records for "all offenses" 

 

On the I129F, I listed three offenses.. Provided an explanation and court docs. The RFE only mentions one of the three 

 

So per the above instructions, "provide docs for all offenses" am I only needing to submit for the disorderly conduct or everything all over again?

Over the years we have seen the basis of your RFE requested for others. It's a simple fix. The agent has made up their minds with an approval BUT one piece of information is missing, hence the RFE. So, if you send back to them exactly what they are asking for then you have a near 100% approved application. Rarely with this kind of RFE is someone denied. Having said that, don't overdo the reply where you give too much information that can evidentially be used against you. Just give them what they want not what you want them to have. Remember, he who has the gold makes the rules. An RFE is a form of "gold". 

 

Yes, you can use a different envelope, but you are only sending back a one- or two-page letter as your response so why the "larger" envelope? Just saying. 

 

I mention the signature because about 1-2 years ago many were being asked to sign their RFE and if they didn't (because they missed that item) they were denied. Stupid :bonk: I know but they have the "gold".

Can you go to your app store and download an app that will turn your picture into a PDF and then once you have taken a picture and created the PDF (remove any personal information) then upload it here. I want to be sure that I am 100% assured that my answer corresponds to what they are asking for. There are many apps that do this, but you'll have to search for it.

The RFE addresses three areas. Bona Fide relationship, criminal records and two year meeting. 

 

Bona Fide asks for information about her previous petition. Plus asks for proof of our bona fide relationship. That would be several pages for proofs.. Chat logs, proof of financial support, evidence of more in person meetings..

 

The two year meeting requirement. Sarge said send in what I had originally. That was 50 pages of flight itineraries, hotel reservations, passport stamp, receipts and the likes. How will that fit in a tiny envelope?

Bona Fide relationship. USCIS will except affidavits from third parties who can affirm that they have personal knowledge of your relationship and can provide details in the form of a affidavit and notarized. Each affidavit must contain the full name and address of the person making the affidavit; date and place of birth of the person making the affidavit; and complete information and details explaining how the person acquired his or her knowledge of your relationship. Ideally, these individuals are U.S. citizens or permanent residents. Each of you can submit a 2-3 paragraph letter to include your own affidavits stating in your own words how you met and how you intend to share your life together. I recommend also providing a sprinkling of emails and texts messages between the two of you, as well as other relevant and persuasive evidence showing your intent to eventually live together at the soonest feasible opportunity. In your response include the details of the previous relationship. Short and to the point only a paragraph or two.

 

Two-year meeting: Include evidence that you have met in person, passport stamps, hotel receipts, charge card receipts that show what country the purchase was made, and plane tickets are good evidence. Pictures together especially those that were taken with a recognizable background. Pictures with family members are good. Be sure to label them where you are and who is in the picture if it is not you or her. Parents make excellent evidence in pictures as it denotes their expectance of you into their family. Eight to ten photos are all that is needed. I had digital photos and I pasted four to a page in word and then printed them on a color laser printer and the quality was good.

 

Criminal records. Follow their requirements for the criminal records. Submit only the record they are requesting. 

 

Most of this will be in a larger envelope or in a small shipping box from USPS. Your submittal should only be about 15 pages at the most but that depends on the criminal records. Keep it to the point and not go off with all the extra "stuff". They don't have time to read and study your submittal. They want a concise answer so they can put a "bow" around your file that says APPROVED! So, do what do will do. :thumbs:

If you use the letter as your guide and follow what they are asking for then you will be good to go. Use the letter as a checklist. Again, don't do more than what is asked for in the RFE. Keep it simple and you are on your way to an approval.

Timeline

Just want to point out that the first point is requesting evidence of your bonified intent to marry, not proof of your relationship. It may be a fine line, but it is different nonetheless and should be taken into consideration.

If my fiance wrote one, would she need it notarized and have wet signature?  Everything is locked down in the Philippines. Don't know if she can get ahold of a notary.

How do I break down what I already submitted into something smaller? Including all the above was 50 pages or so. I only had two boarding passes and unfortunately her name was not on any of the hotel reservations.

Man! My proof of relationship was nothing fancy like that. Couple photos, airplane tickets and passport stamps. To give you my honest opinion, which you might not like but it’s just what I’m thinking, is, that they want to see evidence of a real bonafide relationship. Pretty simple but where I think the red flag comes from is that she had a prior petitioner last year ? What must they think? She’s trying to find someone to get to the USA at any cost? And now she has another one 6 months from the face to face visit? I’m not sure if Philippines is one of the countries under the “fraud watch” but that would be my guessing. I would personally get statements from your side (Family,friends) and her side notarized. 
 

Hopefully that didn’t come out as rude or anything, just the way I think THEY see it

The RFE didn't mention under "two year meeting" what documentation I had already submitted nor suggested what potential items I could submit. Rather stated to include a personal statement of the place, date and circumstances of meeting and to include evidence.  That was it. 

 

She was engaged in April 2018 to another guy. He visited then and never came back. They received NOA2, but broke up in Jan of 2019. We got engaged in Nov 2019. So it had been a year and a half since she had seen him.

Use your energy to address the RFE you only have one shot. Beneficiaries having been petitioned multiple times in short time spans is a big deal. They are giving you a chance to explain it to them. Take this chance don't  read into it.

I appreciate the help. I just want to make sure I send what they want and not too much nor too little. Addressing the previous petition is easy. Knowing what evidence of my meeting with her on top of what I already submitted is a guessing game.
