Why would you need that? Don't they already have records from what they pulled? So they are targeting people who have had their records sealed/expunged and or dismissed. 

 

Why didn't they ask about that when you initially filled out the I129f. It just adds time to an already timely process. 

 

What if don't remember the events? For some, they may be decades ago.

The man with the gold makes the rules. Our responsibility is to adhere to what they asked for. If not no visa. Simple.

As far as USCIS is concerned there is no such thing as sealed/expunged and or dismissed records as all these can and WILL be opened and found out. USCIS could care less if you remember the events or not. If you want the benefit you'll have NO CHOICE other than comply!!!!! And yes they target people with those kinds of records!!!! I think that's what @Greenbaum

Was trying to say.

It was a disorderly conduct charge from 20 years ago. I provided everything they asked for on my original submission. Explanation of the circumstances of the charge, original certified letter stating it was expunged or not found. I don't know what more they want.

No. But I'm 100% sure that's what the RFE is about. Everything I do comes back to that. My Schengen visa, my security clearance, global entry.

Well you never know, if you sent the proper paperwork the first time it could be something else. Just relax and wait till you hey it before you start to stress it

Timeline

@Greenbaum I wanted to ask about arrests. I was arrested around 2007, but I can barely remember the date. I was in handcuffs for 2-3 hours then released for not paying moving violations, but told to pay the fines. There are no records, and I don’t remember how much I paid. Any advice on how to handle this for my fiancé’s interview? We’re post NOA2 (5/12) and just waiting for the NVC to do their thing.

This could be a problem. The petition asks specifically if you have ever been arrested. Emphasis on 'ever.' It is in plain English.

 

I would prepare for it to come up during the interview. Provide all of the court and police documents to your fiance(e), along with a good explananation. Best case scenario the officer won't bring it up. Worst case scenario this will be questioned, and the visa will be denied as a result failing to disclose your arrest. I hole the odds are in your favor my friend. It is a silly thing to get denied for.
