I called NVC ,the lady that answered said that they have stopped sending approved petitions to all embassies for now until they open since Embassies cannot process the cases anyway. But that they will continue to process cases and assign case numbers to avoid backlog . They also confirmed that K1's visa are not affected by any POTUS ban except the worldwide closure of embassies. As soon as local embassies open and send request to NVC that they are ready to receive cases, they will forward cases to them for further processing. So I guess we all stuck at NVC.

You said petitions to embassies but is going from NOA1 to NOA2 being delayed if the embassy (in my case in Brazil) is not open?

No, The delay is because of reduced manpower. USCIS continues to adjudicate petitions according to their present capacity. There is still progress from NOA1-NOA2

My RFE sent April 10th received April 14th was due to needing certified copies of court records from my background check. Resolved and sent information within 2 days back to USCIS.👏🙌 Clean my hands with it waiting for the NOA2 now

How did you go about getting certified copies of your court records? I just got my rfe letter and that’s what they want from me. I’ve been looking at the court’s website and it looks like it’s a long process to get the records. Did you already have yours or did you have to request them?

There is usually information on the county court's website about how to obtain the certified records. Key word: certified. I got mine in about a week after requesting them and paying a $5 fee. They emailed a copy and mailed the certified copy.

Simply call them Monday and if their open they will email it to you or mail it. You can even pick it up if possible. If they aren’t open you’ll have to wait until their open.

I called the court and requested certified copies. They mailed them to me with a few days. You want a physical certified letter. Not a digitally printed one.

I had records in two different states. They are from nearly 20 years ago. For one state I merely called the court house as described above. It's a tiny town and I knew who to talk to. For the other state, I went to the state Bureau of Criminal Investigation and got a state background check within a few minutes. These cases were expunged and I didn't remember what court I had gone through and wasn't sure where to request anything.

On the website it said it can take 4 weeks: I hope it’s not that long. The court is in another state also. But it’s 2.5 hours away. I did call last night and their automated system said they aren’t taking calls during this time. I’ll try again on Monday to see what’s up. But I really hope it’s not something that is going to take weeks. They also want the police report from the arrest smh. So that’s a whole other hurdle. I did find the case online through the courts record search. Shows all charges and dispositions but I kno that’s not enough for them. Wish I could just print that out and show them the case was dismissed! If it’s going to be quicker to pick them up I’ll take the drive instead of waiting 4 weeks though. Luckily it’s only one case I have to worry about and not a bunch. And also its good to kno that’s the only issue with my petition. But dang they want a lot smh. And I gotta spend money for these docs too ughh. I just hope its not a long process getting them.

It's not expunged is it? If so, you can probably be good with a state criminal record showing no records exist.

Are they old records? I'm starting to wonder if the delays with getting RFE or approvals are because of past criminal history. Mine is nearly 20 years old.

I was thinking that also, but we have a small sample size so we couldn't be sure. Could just be coincidence. Mine is 14 years old.

I've lived in two different US states as well as Spain in 2008. Maybe that has some influence as well

It was dismissed in court, no conviction. So basically just an arrest. It was for drinking and driving. And it was 8 years ago. I don’t understand how they can’t easily find that information out for themselves. All these backgrounds checks they supposedly do they should be able to see the disposition of all or any cases under the petitioners name in a system somewhere. 🤦🏽‍♀️

This is what’s online. This should be enough for them lol clearly says DISMISSED! Wish I can just send them all the information on that page, cuz there’s a lot of it. All court dates, all the things I did that they asked me to do. Victims panel, treatment classes, fees I paid. It’s all there. Only problem is that it’s not a certified document form the courts and therefore it’s not what they want from me according to the RFE 🙄

The county website had an email that I sent to the clerk and she said I could pick them up the next day. It basically is just a red stamp and it's signed by the clerk I guess that makes it certified
