December 2019 I-129F (K1) Filers

Someone said they contacted the US embassy and was told that K1 is NOT EXEMPT from the Immigration Suspension Trump put in place last week.

Perhaps now seems frustrating waiting for NOA2 and seeing other getting their approvals, at the end getting it later, will be more like a favour for us.

We did a Live with the Jamaican embassy today and they confirmed that k1 was not exempt.

Same embassy that the other person was posting about. I'll wait for solid evidence of whether or not the Manila embassy is issuing K1 before I start banging my head against the wall.

Timeline

Most embassies, if not all, are closed anyways. Meaning, the EO has not affected anyone yet. Hopefully, like everything else embassies will reopen in the near future as well. In the meantime, either there will be a clarification on how K1 visas are effected by the EO, or we will learn by common practice of how embassies are interpreting the EO.

 

More likely then not this category should be exempt by reason. Reason, however, is what this administration is lacking. I mean besides from immigration, which is a really sensitive topic and we all can level with it, suggesting to inject disifectant, tysol, as a cure to the virus - seriously. 

 

Let's us stay positive. I have to admit that my psych has really been affected by everything that is going on, I still believe there will be a happy ending to all of this.

I definitely don't want to get married in the Philippines... That route is so slow. She has two young kids and we want more right away. I couldn't stand being separated from them in only being able to go visit a few weeks each year.

I thought this might be useful for you in case you get approved and cannot get a interview straight away: 

 

The I-129F petition is valid for four months from the date of approval by USCIS. A consular officer can extend the validity of the petition if it expires before visa processing is completed.

The Proclamation does not affect individuals seeking to enter the United States as nonimmigrant temporary workers or visitors, nor does it affect nonimmigrant visa processing by United States Citizenship & Immigration Services (USCIS) or the U.S. Department of State (DOS):

  • Temporary investor visa application submission and processing will continue to be allowed.
  • USCIS will continue to accept and process petitions and applications, including extensions for foreign workers and their family members.
  • Nonimmigrant processing of "temporary" visas is not covered, which includes visitors and tourists; F-1 students; H-2A agriculture workers; H-2B temporary workers; H-1B specialty occupation workers; J-1 exchange visitors, including au pairs; K-1 fiancé visas; L-1 intracompany transferees; P-1/2/3 performers; R-1 temporary religious workers; TN (Trade NAFTA) professionals; and VAWA victims of domestic violence.
  • USCIS will continue to accept H-1B cap petition filings for those foreign nationals selected in the recent H-1B cap lottery. The selection process ended on March 31, and the petitions must be filed by June 30.
  • Employers may initiate and proceed with sponsorship for green cards for foreign workers, but the employee may not complete the process outside the United States during the suspension period.
  • Employees with approved employer-sponsored cases may complete the process through adjustment of status within the United States.
  • Students and foreign graduates of U.S. colleges and universities with Practical Training employment authorization are allowed to work.
  • Naturalization application processing will not be suspended.

Marrying in the PI is not slow if you know the shortcuts. It can be done in less than 20 days if she is free to marry.

The statement made by our President did not include the wording "tysol" [Lysol] or any other named disinfectant. He used the word "disinfectant" as a medical product reference that would act like a disinfectant. Then social media and the left-wing media ran with this to smear the President. He used the introduction of "light" to kill a virus. Is he telling us to use a UV lamp and shove into our bodies? That would be like your suggestion of using Lysol, but you make no mention of that.

 

Here is his statement. Please show me where he said Lysol usage.

But it sounds — it sounds interesting to me.

 

So we’ll see. But the whole concept of the light, the way it kills it in one minute, that’s — that’s pretty powerful.

 

On your second note you are missing the point on President Trumps immigration policy. I often question what his motives are but when I do, I try and educate myself on "what's behind" the proclamation. There is so much that the American people do not understand and do not have the intelligence that he derives from CIA, FBI, or Homeland Security. So, we tend to tie his references to our own personal situation which causes us to miss the "big picture" and only think of ourselves. Just expressing my opinion from a different perspective.

The NOA2 is good for one year. The embassy can renew it at four months at a time. The Philippines is the easiest embassy to receive a visa from. We don't know at this time what the opening will look like. But it's my guess it won't be any different than before.

@Greenbaum I doubt if things will ever be the same, I do not expect any normalcy  till the end of the year...we will probably have to wear mask to USCIS offices  and to Embassies/Consulates. My concern is if the lock down is being lifted in the US and Germany is planing on opening May 5 will the embassies open up at least?  Then again my thought goes back to the EO 😌  and its assumed effect on K1 visas ...its just exhausting .
