Just look around on VJ and you would be surprised how many people don't even reach the current  poverty income levels. That's why I said many people are going to have it very rough after the 24th of February.

I'm  talking at the AOS  level.  It's  fairly easy at the K1  level.  Many embassies don't even ask for the I-134, but for AOS the Affidavit of Support is required.

Q1 - Yes that is per year.

Q2 - I for one am not sure. It's all so new. It's at a stage where we will throw it to the wall and see what sticks. I did read that they are not going to go back in history but will look at current obligations. Here is an explanation but only one from a lawyer.

Changes to August 2019 Version of the Rule

When the DHS implements the new public charge rule on February 24th, there will be a few small, but important, changes from the version that was finalized in August 2019. First of all, the rule will not be enforced in the State of Illinois. This is because a federal judge in Illinois issued an injunction against the rule being enforced in that state; the Supreme Court reversed the nationwide injunctions issued by other federal judges, but left this state-specific injunction in Illinois untouched. If the Illinois injunction is eventually lifted, the DHS will provide updated guidance.

Second, the DHS will not consider a foreign national’s application for, certification or approval to receive, or receipt of certain non-cash public benefits before February 24, 2020, when deciding whether the individual is likely at any time to become a public charge. Similarly, the DHS will not apply the new public charge rule to applications or petitions filed before February 24, 2020. Under the original version of the final rule, the DHS was to apply the rule to public benefits received, and applications and petitions filed, on or after October 15, 2019, which was when the rule initially was scheduled to go into effect. In light of the delay in implementation caused by the injunctions, the DHS has changed the date to February 24, 2020.

I know we're still not sure about all the details, and I know there's a larger thread about this issue elsewhere on this site, but I'm wondering if I can take the easy way out and just ask this question here. My Filipina fiancee has little education, formal work experience, money, credit, etc. She's from a smallish Pampanga city next to a river, and basically cooks all day for her family. We plan to AOS as soon as possible. Over time, we may get her an education, a job, build some credit, etc, but that will take quite a while, definitely after AOSing. She may just want to be a stay-at-home wife, and that's fine by me also. My question is, are they looking closely at the immigrant and their risk of public charge based on their personal story, or will I be included in that also? I make well above the poverty guideline, will add her to my employer's health insurance, and she will never become a public charge under my watch. Should we expect to have any issues with AOS?

My opinion. If you make well above the poverty levels. Have been financial fine throughout what every period they will look at then I do not see this being much of a threat to you. It's more for the person who is close to or under the poverty level that's going to have a problem. I don't think you will have a problem.

I should be fine either way, way above the limits for my household size. I need to stop worrying so much about every single thing. 😄

Okay, let's change the subject for a minute.  I got a question.  From the time the beneficiary arrives in the U.S. and gets married, how many times for the next 4 months will we have to go to government offices in our state for various paperwork,  if any?  Thanks

Depends what you want, how things work in your state (and where you want to get married), and how fast your case is processed.

 

Things you'll want/need to do in CA

  • Apply for an SSN before marrying (not required, but this is helpful)
  • Get a marriage license (obviously have to do this in order to get married)
  • Have a civil wedding (not required if you'd rather have your legal wedding be performed by someone else; also, in some counties you can get a marriage license and get married in one visit to the county clerk's office, but you can't in others)
  • pick up certified copies of your marriage certificate (you can get them mailed to you, but this costs extra)
  • get a state ID, driver's license, or learner's permit (in CA you can get an AB60 license with just your NOA1 from AOS, but it's not a fast process; if you have your EAD, you can get a regular driver's license or state ID)
  • if you changed your name through marriage, go back to the SSA office to get a new SSN card with your new name (can only do this after EAD which probably won't happen in four months; also, you can skip this)
  • go to the local USCIS field office for your interview (this probably won't happen within four months, but could if you're at a very fast office like Fresno)
  • after getting your green card, go to the SSA office a third time to get an SSN card that doesn't have the 'valid for work only with DHS authorization' text

Can you not get that statement removed from your SS card with an EAD? You stated GC, but sometimes EADs come  well before a GC.
