The poverty income levels went up at the beginning of the year. Most can get into the country if they have a sponsor but it's what happens later. Does the sponsor want to continue with their sponsorship because for the AOS it's now a legal document and the Federal Government can go after the sponsor to re-coup any public assistance. The guidelines are their because those who fall below have a more propensity to become dependent on the government for assistance. That's why they are there for this process, is to have a tool to which history shows that those below have a harder road to travel to exist.

Can you link to the new levels, please? I think they were really low previously. How can people survive in some areas on such a limited amount.

So my question is this, expecially to @Greenbaumand @Sarge2155 let's say someone comes in on k1, get married obviously the petitioners income was enough to cover I-134 retirements then he or she falls short at AOS because of  i-944 no skills, age, no education etc what happens? Can't adjust to GC? Thrown out of the states? Any ideas anyone?

Can you post the new income levels? I’ve been looking everywhere and can’t find it.

I looked on the USCIS website, but don't see anything. Only the 2019 I guess are still in place?

If the income level  is above what  the IO deems acceptable not to pose a public charge  then the GC will be approved  via the AOS, if not then the immigrant/petitioner will have to get a co sponsor or the GC will not be approved. The IO has much latitude to decide what is acceptable  income and or assets in order to determine a future public charge. IMO they will use that latitude even more, so expect  many more denials  come  FEBRUARY 24th. Unfortunate but that's the deal!

Ok I just checked as well and didn’t see anything. I also checked out the new I-944 form and that thing is a beast😒. It seriously digs into ALL your business. Credit score, education, 401k, etc. In my opinion, this is just a bit absurd.

Well thankfully they will give people a chance to get a joint sponsor hopefully before immediately denying them.

We don't know how this will play out. With anything that is new they are going to stick to the "letter" of the law. Later on it will ease up somewhat. We'll just have to wait and see.

Not really the way USCIS sees it. It's all about being able to hit the ground running so to speak, self sufficiency. There are cases where even the co sponsor does not qualify. It's way beyond just a co sponsor. Take a look at the new form I-944 and you'll see what I mean.

I agree I'm thinking they will start out with a bang, and then there will be numerous other court challenges before it sticks. But that does not help the initial people going through it.
