I’m not any kind of attorney but I would say yes. I say this because USCIS has nothing to do with the Embassy or the countries laws. And K1 is a non-immigrant Visa but just handles like it is an immigrant visa. So I guess short answer is yes, as long as you qualify for it. Also, the NVC doesn’t require anything for the K1 so it gets a case number and gets sent to the embassy where your partner lives.

I didnt apply for expedited requests because i didnt see it as a reason listed...but i wish it does go fast 🙏

NVC doe requires certain things to be completed on the approved application from USCIS. 

 

When NVC receives the approved 129f from USCIS, They check to ensure that it’s been stamped. Occasionally NVC will receive a petition from USCIS and it does not have the appropriate approval stamp in the upper left-hand corner. NVC is also checking to make sure that the three criminal questions have been answered. NVC noted that there are times when the petitioner will forget to complete those questions and those questions are subsequently missed by the adjudicator.  In both of these instances, the case will then be sent back to USCIS. If one of these things occur NVC would know within the first week of receiving the case.

NO they do not get expedited same sex. You are correct, it is not part of the expedited requirements.

Just like I meant, NVC does not require anything from the beneficiary like the I130 does. You’re talking about mistakes made at USCIS. So I stand correct with my comment. We can what if all day.

Relax dude. The information I provide is to help you but also others. You were wrong in many of the other things you opined about hence I found it necessary to correct that information also. 1-3 weeks is the normal turnaround time after they have received your file and cashed your check.
