December 2019 I-129F (K1) Filers

Last time my fiance checked the post office was on 12nd. No NOA2. Called them on 15th. No NOA2. 

Come to find out they returned it to USCIS on the 15th after he had made the call.

What does this mean? Why would this happen?

This has no impact on your case from moving forward. You can call USCIS and talk to a tier two agent and explain what had happen and ask that a copy be Faxed to you so you will not depend on the  mail again. Have a FAX number available where they can send it to. If you don't have access to a FAX then use one of the FAX services online. Google and you will find many who will accept a FAX and then email it to you. Cheap to use. Some are even free.

Honestly, I didn't even think they were working on applications due to Covid. I was thrilled to get an RFE just to know they were working on it! We just didn't know what kind of proof to send for our intent to marry.

They list examples of what proof to send in the RFE. Seek out those documents that are being requested and submit as the answer to your RFE. If you have questions, ask them here and someone will be glad to help. You're not alone in this process.

Thank you! They received our RFE on May 27th. Thats all we know at this point.

I know this must have been addressed before but is there any rhyme or reason why someone who applied later would be approved before?  I would assume that they would adjudicate applications in order but is it just completely random? If so - is that the system that they want? Sort of like getting lucky in life and just completely random?

Some people might have a more complicated case. Others might require a more extensive background check. Adjudicators do not move at the same speed.

Let's drill down into your question. For argument sake let's say you and Mr. Bob apply for a I-129f, Petition for Alien Fiancé(e) but he is first in and your application is about a week after his. You are from a friendly country to the US and MB is from a more of a third world nation where bookkeeping isn't their strong suit. So USCIS does background checks and since your country comes back quickly with the information needed your file is about to move on to the next step but WAIT..... MB is still waiting for his background checks to be completed. So, since you wanted this to be fair and work first in first out then your file will sit till MB's is completed. But MB's BG check takes 2-3 months to be resolved but now it's ready to be shipped out to NVC with an approval. And yours is not ready for release because under your system he was first in so you had to wait but now your file is "free" to move to NVC also because MB's file is complete.

 

Now I hope you have a better understanding why first in first out doesn't work. When they are complete, they get shipped out. People applying are from different ethnic backgrounds, cultures, countries', and diverse backgrounds so each is processing differently. Think of the backlog that your first in first out system would cause.

 

These are older documents/testaments to how background checks are conducted. The information in general is true today as it was when it was written. I hope you gain some knowledge as to why it takes as long as it does.

Ahh. Thanks. I was digging also and I see that they are doing a background check on the foreigner. 
 

So the main cause of delay is with the foreigner’s country and not with the USCIS. Thanks.

No not necessarily. USC can have a slew of background problems that need to be sorted out. Let's say a USC was in the military and he worked under theTop-Secret status for his MOS. He traveled to numerus countries and so they all need to be sorted out. That will take time. There is a group of USCIS agents in Vermont that do this type of background checks. Those takes upwards of a year or more. There is one fellow now who is almost a year in waiting for his background checks and he was X-military. There are others but I won't name them here.
