Police clearance problem (merged threads)

Ok, so we have our NOA2 and just waiting on my state dept letter. My Filipina wife and I lived in China for a few years and long story short she needs to execute a power of atty and other documents....again very long story.

 

The Chinese Embassy (who will authenticate her documents) requires...

 

1. Notarized documents (no problem)

2. Regional Trial Court authentication.....THIS IS WHERE I AM CONFUSED AND HAVE FOUND LITTLE INFO ONLINE AS TO COST/TIME TAKEN/PROCEDURE

 

3. Dept Foreign Affairs authentication (pretty straight forward)

 

4. China Embassy for their little authentication procedure

 

 

Anyone ever hear of the Regional Trial Court part? I have seen it mentioned, and my Chinese atty said we need it as well.

Yes but the question is in regards to receiving documents from China, so it would be best to ask in the Chinese forum where others likely have answers for you and know the process, or where others may have already asked and been answered

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

Ok so as of now we have the State Dept letter coming and soon to submit NVC documents. My wife is Filipina and applying at the US Embassy in Manila.

 

The only area that concerns me is the police check. She has NO record in PH and can easily get a clean NBI or other clearances, no problem,

 

We are having a serious problem getting the Chinese authorities to issue her a Chinese police clearance (we lived there for 3 years).

 

My attorney in China has been working on this since April, and we are in the last few days of this process. 

 

In your experiences... if one cannot secure a police clearance from a secondary country for the US visa, but can supply evidence and a letter from an attorney explaining the reluctance of the Chinese to do so....is this usually a real problem to getting a visa?

 

I KNOW and have read the State Dept policy. I am asking for personal experiences.

 

And this is NOT a China specific question.

Again, this is concerning the US Embassy for a Filipino citizen in Manila. It would be the same for any background check from any country.

No. It's not a Filipino issue.   Its about getting a police clearance from Chinese authorities FROM China.  People who have interviewed in China do this as a STANDARD practice and possibly could share tips and techniques to get it done

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
