Hi guys, my fiancee is from Venezuela and she is currently residing in Quito-Ecuador, her immigration status in Ecuador is illegal.

We already met each other and I am planning to file a K1 visa on her behalf, but my concern is if her immigrant status in  Ecuador will affect negatively on her visa application and if it will be reason to be disqualified for the K1 visa, she will have to have the interview in Bogota? Please if someone can give me the right advice and clarify my doubts. Thank you!!! 

PD. I need to hire a lawyer to file this application? they are really expensive.

Her immigration status in Ecuador does not matter other than she can't interview there

It won’t affect her negatively except that she might not be interviewed in Ecuador. You don’t need a lawyer for this process, my mother in law and now  husband put together the K1 package , follow the guides on this forum they’re easy to follow and you can always ask questions for any doubts you have.

Get her legalized in Ecuador, it is pretty easy. There's a visa for Venezuelans out of status, https://www.consuladovirtual.gob.ec/web/guest/preguntas-frecuentes 

If she becomes legal and has ties in Ecuador she can interview at that embassy.

My fiancé is also from Venezuela, since there is no US embassy there anymore she will have to interview in Bogota. Her issue might be if they send paperwork to her Venezuelan address? She also has to get a physical in her home country (Venezuela) paid for in Venezuelan money, so being in Ecuador is probably not helping. We just started the process ourselves and our K1 package was officially acknowledged as received from USCIS today! Personally I am using a company to help with the VISA paperwork, since I don't want any mistakes with anything, so it may be worth it.

FYI the medical must be done in Colombia it costs around 660.000 Colombian pesos. They don’t send correspondence to your physical address. The package with instructions is sent to both petitioner and beneficiary email address.

Why would the physical be in Colombia? She is a resident of Venezuela, doesn’t make sense.

Because there is no embassy in Venezuela anymore and thus no approved facility to do the medical in Venezuela

Because the physical must be done by a doctor of the same post. She must arrive at least 10 days before her interview.

I forgot to mention that since the embassy was closed that has been the procedure. I had to do it myself in March.

That can't be right this only 19 cents US....

660k Colombian pesos is around 190 usd. If you like I can send you the package with instructions from the embassy. There’s all the info you need.is in Spanish though.
