Precarious Situation: Long Interview Moments Ago but Undecided

In your case there are only two ways they can deny you: criminal history and moral grounds. 
 

Extra-marital affairs are not criminal. Bill Clinton had a ####### in the oval office with a White House intern and Donald Trump slept with a porn star while his wife was pregnant. None of them violated the laws. 
 

So the only thing the IO can lean on is is moral ground. That’s pretty shaky. I don’t think any supervisor in their right mind will do it. There is just no way. Even if you had an affair, divorced your wife and married someone else, they can’t do it, as long as your first marriage was entered in good faith.

 

If they do deny, I would file an appeal instantly with a good immigration lawyer. I don’t think USCIS has a case here based on what was presented.

By law they are required to decide your case within 120 days after the interview, after that you can start pulling strings to force them to make a decision....the decision may not be on your favor. 

As said by others I think you will approved based on the info you provided.

Well you have to understand your case is not the only case they are working on. The Officer that interviews you has to prepare the case to give to a supervisor (probably allow up to 30 days for that) then the supervisor has to review it (another 30 days or so for that to happen) then they have to give it back to your Officer to actually process (add another 30 days)  So it could be is around 30 days as the quickest possible for all that to happen but more likely around 60-90 days is more realistic. The max it could take is 120 days. Your local office is not as busy as some of the other ones so it shouldnt take the max time.  It may also take them time if they are doing research on prior denials or approvals with that scenario. 

 

Just remember the law does allow them to deny you for this, it would just be highly unusual. If you are denied you should be able to reapply very quickly as its been so long. You can reapply when 5yrs have passed from the date of affair/divorce. You could also try to appeal and include evidence of GMC but I dont know how successful that would be. I hope this works out in a positive way for you! Please post back when you get an answer!

I just feel this could have been an easy decision to make on the spot during interview  rather than go through this

It's not overly common for N400s to be adjudicated on-the-spot unless it's a supervisor conducting the interview themselves.  Almost all go through supervisor review (whether recommended for approval or recommended for denial)...even the most straightforward of cases.

 

Don't lose hope---call USCIS and hopefully they can give you some piece of mind (one key question would be to ask if you are "in line for your oath ceremony".  Sometimes it's also happened where people have called and discovered that the oath letter was sent out and they never received it via mail, so it's a good idea to remain proactive where you can.

 how long will this scheduling take?

I know they say 30days yari yari yari but does anyone know  how long it takes for the letter to drop
