Valid Green Card not accepted as identification? Please help

I don't know which forum to post this in - please move as appropriate

 

As per the title: 
We're in the middle of a mortgage transaction. The underwriter of the title company stated that they will not accept my USCIS issued ID because (and I'm quoting this straight from an email!) "Immigration just puts down whatever name she tells them." 

I do not have a DL 
My passport with my visa is in my former married name and clearly I am not going to use that to go onto the title to a home I share with my loving husband. 

Is there anything I can print off/refer them to? We already sent them a state appropriate statute which they told us is "open to interpretation." 

I am so furious right now but I need something I can present to them.

PS I have conducted all my affairs, payroll, tax, bank accounts, travel etc with my GC. No issues.

Good lord, that sounds shady and completely obnoxious on their part. I'm so sorry. Do you have, or can you obtain a state ID? Getting a state ID in MD at least, is a pretty straightforward process provided you've got the documentation. Surely they wouldn't reject that. Green card is a federally recognized document that proves who you are and there should be no reason they would reject it, except it seems out of ignorance and I should think you could complain to someone about this. The law is the law. They are discriminating and personally I wouldn't dare do business with them.

What fly by night firm are you using?  Our mortgage company insisted on a scanned green card.

With that said - what’s the mortgage have to do with the title.  You can be on the title of the home without being on the mortgage.

Yes, I can easily get state ID. And I know I can - it's not a problem to do that. But why should I?  These people have given us the run around since the get-go and I'm tired of jumping through hoops for legal 'experts' who are ignoring the law. 

It's not like we went to some underground place to mortgage a house. This is the underwriter for the Title Company. I'm so furious! 

And for once, I'm actually feeling plenty love for the government, given the way I'm being treated by the private sector lol

We asked about that - Florida is a Spousal state so with Homestead Law, I have to be on the mortgage whether or not I'm on the loan or title.

The mortgage company and the title company are two completely separate entities.

You are confusing two issues and it is unclear who exactly is not accepting your ID

Oh my! This is total BS. 

 

The Green Card is issued by the United States Government, it's a valid photo identification document. In fact on I9 the Green Card is on LIST A, DLs are on LIST B.

 

Are they kidding???

It's the title company. 

Sorry for being cryptic. 

And yes, we know that the mortgage and title co are separate, but the mortgage company will only use the information that the title company approves. They want their docs to match. We've spent the last 6 weeks of our lives going back and forth about this and we aren't getting anywhere. I'm just so exhausted and frustrated.

There is no such thing as an “underwriter for a title company”. 

Every mortgage goes through underwriting, but the title company is who collects all the money, pays it out, writes the title policy, and records the deed.

My husband and I went through mortgage process with me being a GC holder and underwriter had no problem with my scanned GC. Are you sure it`s not just  a misunderstanding?

We sent them the Statute (FL Law) and highlighted this.  Florida is also one of two states that exercises 'reasonable reliance on presentation' 

The I9 is listed on the statute we sent them (highlighted).

They are using the underwriter (talking about the title co here) to push back. THey will NOT tell us the name of the underwriter (the escrow closing agent told us this morning it's a company and refused to give us the information).  

Is this state specific?  I'm not questioning you at all. This may be very helpful. But I don't know how to present this information to them.

copy this USCIS site and take to title office

if the government accepts these as formal ID , anyone should 

other than that ask the mortgage company to go with a new underwriting office or you will take your business elsewhere

Could you be talking about the title insurance policy?
