Does the k1 visa reduce my love's social welfare benefits?

hello, everyone

I am come from Taiwan. hope my English will not so bad to ask.

the story is about me(age 28 male ) and my lover (American, age 75 male)

We apply the K1 visa from half year before.

and he already got the letter said its approve .(I believe that is NOA2)

BUT!! at this moment....he got the seriously fall...and send to hospital.

He got brain bleed. and now is at rehab center.

Because Most of the things he take care...so about K1 visa I dont know too much.

some of his friend really worry and try to tell me I should not marry because If we marry his social security and food stamps or all kind stuff might reduce even gone.

Than I have to burden all of it.

we are not rich. so we do the K1 visa even need his friend to sponsor me.

I don't want to be his friend's trouble (if his all kind of walfare gone and I have to take care all of economic burden....I know even I work in US may not take care it...his medical will the most hard one)

Can someone can answer me about this? Is his social welfare benefits will cut off or reduce because we marry?

Also...he got the letter but I still not get any letter or package yet....is that right?(He got letter at Oct.15)

Social security should be unaffected. Due to his age, even survivor benefits should not be impacted.

 

Public assistance/Welfare programs are generally based upon income and household size. They may or may not be impacted...you need to check on the specific program requirements, which often vary from state to state.

He does sound seriously ill

and unless he is able to support you and give you a home and has the necessary income to support the visa,  it would be denied at the interview

he has to fill out a I 134 form with his income

while in hospital and rehab ,  food stamps are already gone

while in rehab,  his medicare will pay for him to be there for only a certain amount of time (i think 30 days),  then they attach his SS money (means that money goes to pay for the rehab care)

and since you can not work for quite a few months (if you did get approved which sounds unlikely),  there is no money to live on

 

he would get the letter at this point and let you know,   you would not get the NOA2 (Oct letter)

but until he gets tax transcripts and you are told to fill out ds 160,  the K1 will go no further

If all he lives on is SS,  he proabably does not file IRS taxes,  so not sure how any of this will go as he has to send a copy of them to you

Depends on the source of the SS. If it was due to survivorship and he remarried, normally this would terminate that income source. But over a certain age (60 iirc?) that is exempt.

 

If it is one’s own SS, then marriage won’t impact that.

Actually it is not 30 but 100 if he meets the requirements and if he has family to care for him this is what happens

 

Many people believe that Medicare covers nursing home stays. In fact Medicare's coverage of nursing home care is quite limited. Medicare covers up to 100 days of "skilled nursing care" per illness, but there are a number of requirements that must be met before the nursing home stay will be covered. The result of these requirements is that Medicare recipients are often discharged from a nursing home before they are ready.

 

If he is forced out of rehab    he could be sent from rehab  to a skilled nursing home,  and there ,  they can do the paperwork to have the SS pay for his care but most nursing homes want more money than SS as they are expensive so family has to come up with the rest of the money

His friends are probably worried that you are taking advantage of him.  

I highly doubt you will be approved for a K1 on the SS earnings of a disabled 75-yr-old man.  
 

SS benefits are dependent on the situation of the one receiving them.  If his SS is based on his own earnings record then they won’t be effected.

So we did got "approve" letter
I dont know how he did, because as I know he lives on is SS.
and we find a sponsor to help us to do next step.
And I know some people will worry i take his advantage.
but tell me this idea is a lady who really know me also him.
and actually when we apply the K1 visa. 
she is one support us to do the paperwork.
she mention about this because he worry me can't afford his all kind of things.
anyway...if we keep going will not let him lose any benefits than i will like to keep try.
I put the letter in the image to make sure it is "approve" one
So....Can someone can tell me who I should call for to ask the next step package?
because already 1.5 months I kind worry.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

it should give you the necessary information. I think if I were you I would find out if NVC has assigned a case number and sent out your petition yet. You can try to call them. If you don't you should eventually receive a letter from them but it might take a while. Good luck!
