Waiting for I-130 to process...can I visit?

Hello!

 

so my situation is currently that I’m a Canadian and my husband is American. He’s my sponsor and I plan on moving to the states. We got our NOA1 two weeks after we filed our visa (July 25th 2019) 

i went to the US from July 15th - November 7th of this year since we were financially capable to have me unemployed and just experience living together while we wait. I went as a visitor & my I-94 required me to leave the country by November 10th.

 

this is such a painful & lengthy process & I miss him a lot. 
 

my question is, can I visit again in February/March of 2020 without our visa being complete & just go for my allowed tourist time. (As a Canadian I get 6 months in a 12 month period) but I know technically you can go back a day after you left, it’s just trouble with border agents. So if anyone could help me out I’d really appreciate it!

You won't really know till you try.. but I would say almost certainly yes.  We know a couple who just recently completed a K-3 interview in Montreal. He was living in California and she in her parents home in BC. She never had any trouble crossing the border into the US for visits and frequently stayed for months. She never tried to hide anything or BS the Border Officer (never a good idea anyway) and always spoke frankly about the reason for her visit.

Removal of conditions

05-02-23 I-751 sent via FedEx.

05-03-23 I-751 delivered to USCIS address in Tempe AZ.

05-09-23 Check for $680 cashed.

05-15-23 Received I-797 NOA (48-month extension). A separate letter saying biometrics to be re-used. A third letter giving online access code.

Awesome, thank you for your input. Ive always been very honest when crossing the border, but even when I went to visit the last time they were very hostile with us. I completely understand their reasoning but we are just simply a married couple wanting to be together while we wait for our legal immigration to complete.
