Naturalization with DV1 Green Card

Hi All,

 

I have some questions and hopefully others can help answer them.

 

I became a permanent resident through the diversity lottery visa in 2011 and I married my husband (naturalized US Citizen) in 2014.

 

My question is regarding what supporting documents to include with my N400 application since I am applying based on being a lawful permanent resident for at least 5 years.

 

The N400 documentation checklist seems to not list documentations required  for my category except for copy of the green card, and check or money order but there are 4 items listed for someone applying for naturalization on the basis of marriage to a US citizen.

 

Should I send the same documentation? Any idea?

Not exactly sure which checklist you are referring to. The N400 instructions are pretty clear, since you are applying under the five year rule, I believe you just have to include a copy of the GC with the application.  There are other items you should gather for the interview.

Timeline

If your spouse didn't sponsor you for an immigrant visa, which seems to be the case, you shouldn't need to include any evidence based on your marriage. You may still need to include IRS tax transcripts to show you've been paying your taxes? I did, maybe someone else can weigh in on that. 

 

The evidence you need should be pretty light though. Mine was a little more hefty because I did apply based on the 3 year  mariage rule.

Reading the instructions, it does appear you can upload the interview documents ahead of time.  Back when my wife filed, we did paper, and just submitted the photocopy of the GC and a copy of the marriage certificate.  She took all the other documents with her to the interview, but the IO never looked at them.  That may have been due to the fact that we also had an I751 pending which you did not have to do.

I just naturalized through DV. I was required to upload green card, marriage certificate (even though it had nothing to do with immigration) and birth certificates of my kids (ditto). (I filed online so it told me what to upload.) Nothing else was asked for and the only thing the interviewing officer wanted to see the original of was my green card.
