Joint Sponsor: needed or not?

We've tried browsing the forum for the answer but we haven't found it ..

 

We just found out that our friend won't be able to be a joint sponsor, but now we are thinking if we even need one? 

 

USC (petitioner) spent the last 6 years serving the US in the USN. He came to Australia from Jan 2019 and flies back to the States in Jan 2020 to (a) re-establish domicile and (b) get a job! He will files taxes for the year he was in Australia but it will be 0 as he did not work due to his Australian visa conditions so no US income and no foreign income. 

 

If the petitioner has a job that is well above the poverty line at the NVC stage, would we still need a joint sponsor? He can provide 3+ years of tax transcripts with only one year (being the when he files taxes in 2020) will be 0. He will (or should) be able to supply letter from employment plus pay stubs for when he gets a job when he moves back. 

 

Will that be enough or give the most recent year was a 0 on his tax, will NVC require a joint sponsor?

 

What about savings in a US bank account? Could that help?

The NVC is does not make the final determination on whether or not a joint sponsor will be required, a CO at the Consulate does.  The CO will consider the totality of the circumstances in determining whether or not a joint sponsor will be necessary for your case.

He does have that option of listing those funds in the assets section on the I-864; however, it's still up to the CO if they want to accept it or not.

So we could proceed to the interview stage with no joint sponsor to be told that we may need one by the consulate?

 

would you suggest then having a Joint sponsor just as a precaution then?

That's a possibility.

I would suggest having someone on standby in case it becomes necessary; with that being said, don't delay proceeding with the steps when the time comes.

yeh, it’s at pike place in Washington! Had our ceremony at Gasworks and photos all over Seattle even though we legally wed in CA.  Husband was born in Seattle!

it seems very easy for people to find joint sponsors from what I see on this site. Unfortunately, I did ask a few and all said no, but I just got a job last minute so I am not sure how that will turn out as my I-864 is already submitted. I don't mean to hijack this thread, but in case you or someone else doesn't find a joint sponsor, so what happens then? I told my husband overseas that if they ask for a joint sponsor, he should tell them that we tried to find one, but were rejected, so that the consulate will know how to proceed. Do they automatically deny you, and send your case back to USCIS and USCIS then denies the whole year-long visa then and then you need to wait a year and start another year of visa form scratch? I honestly feel like I will have a heart attack if this happens to me.

From what I've read, they may give a 221g form requesting you get a joint sponsor. If you don't or can't then I think it does work its way back to the USCIS. 

 

I think if you can convince a CO that you the beneficiary will not become a public charge then that's what they are looking for. As mentioned above, they look at the totality of the circumstances. For example, how likely could the beneficiary get a job? Do they have work skills that can be transferred over from their home country to the US? Are they educated?

thanks so much will do..sorry for hijacking your thread lol im frustrated and needed a rant and you were here LOLOL my parents became sponsors for two people so im frustrated that we helped others but no one wants to help us for which i cant find a joint sponsor now but it seems like reading this forum, most people don't have a problem finding joint sponsors and at this moment in time I can say that i am jealous lol i wish i befriended those joint sponsors myself ))) i wish you good luck in this journey too!
