Timeline

Hello guys,

 

So long story short my lawyer made mistakes and has to re file my AOS this week, she threaten me and said that if we don’t file before DECEMBER 3, that the new fees will come into effect basically she’s only paying the $1225 and I will be in charge of paying the rest, my question is

 

 

WHEN DO THESE INCREASE IN FEES TAKE INTO EFFECT? 
 

or was she just trying to get 500 dllrs from me!

I thought the increase in fees was just a proposal and nothing has come into effect yet ...v

 

Also, do you need a lawyer? Do you have a complicated case? Can't you file it without using a lawyer and get your money back?

 

 

Our Visa Journey:

 

2 April 2018: Married in Santa Ana, California 💒

6 June 2019: Birth of our daughter 👶👨‍👩‍👧

14 October 2019: Sent I-130 package via AusPost 📮 

18 October 2019: NOA1 received - sent to Texas Service Centre :D

24 October 2019: USCIS processed filing fee 🤑 waiting game 🕰️

22 January 2020: Andy moved back to the USA😞 🇺🇸 - re-establish domicile & to get a job 👨‍⚕️

23 February 2020: Petition transferred from Texas Service Centre to Nebraska Service Centre 😞

15 May 2020: I-130 petition approved! 😭😍 Date changes leading up to the approval were: 1 May, 12 May, 13 May. 

16 May 2020: Received NVC email, paid all fees. Waiting for fees to process so we can upload and submit all documents

19 May 2020: Immigrant visa Fees PROCESSED; affidavit of support fee PROCESSED 

28 May 2020: Submitted VISA application, civil documents & affidavit of support documents. Patiently awaiting DQ. 

2 June 2020: Email received from NVC stating that we have been Documentary Qualified and that they will liaise with US Consulate in Sydney for Interview 🐨

27 June 2020: Expedite request submitted 🤞

7 July 2020: Expedite request APPROVED! 😃😭

15 July 2020: Email received advising of interview date and time. 
20 July 2020: Medical i: n Melbourne CBD 🏥     
28 July 2020: US visa interview at US consulate Sydney - refused 221(g) issued. Request for joint sponsor 😞

31 July 2020: uploaded joint sponsor to NVC, emailed consulate 

5 August 2020: emailed received advising they have received the joint sponsor 

7 August 2020: case i0n “administrative processing” 🤞

10 August 2020: visa ISSUED 😭 

12 August 2020: passport and visa in hand!

I'd recommend to not use that lawyer. Also, the forms can be DIY. Recently, there was a proposal but it hasn't been approved yet:

Why use a lawyer?  Just file everything yourselves.  

 

I just checked USCIS, and on 11/8/19 they wrote a notice of a plan to publish a proposal for new fees to cover operating costs, but they have not yet published the proposal.

 

ETA:  The fee increase will not take effect by 12/3/19.

Wow i'd fire your laywer. This 'lawyer' already screwed up once (cause your package would've been accepted if they knew what they were doing). And now she's trying to get more money out of you using a scare tactic.. :(

US entry - July 31, 2019                                                             Green card interview scheduled - August 11, 2020

Our wedding day - Oct. 14, 2019 ❤️                                        Green card interview - September 10, 2020 = APPROVED! :D

                                                                                                       Green card received - September 16, 2020

My ROC Timeline

NOA - July 14, 2022

Fingerprints Were Taken NOA - August 2, 2022

I would file the package myself, and ask the lawyer for the money to pay for it, since it was their fault. There's no new fees, because it's just a proposal.

 

After that, I would sue your lawyer. What they did was dangerous since you could've been deported.

Thank you! And about the lawyer, I just want her to pay her mistake and I’m sending off my packet I just want to catch her in her lie! I knew that the fees weren’t 100%

I’m not using her, all I want from her is the money she made me spent on her mistake ! So no worries :) I’ll be filing again this Wednesday ! And yes she was trying to use a scare tactic to get those extra $500 from me but ain’t happening :)

we still can respond to our opinions about the proposed new fees till December 16th

they do not go into effect till October of 2020 according to the federal register

to note they are also changing they way some fees are paid by starting to use pay.gov instead of a cashier's check or money order / as i said some of the fees 

and all this is a proposal 

 

you are liable now for the $1225 for AOS as new fees are not in place

That’s what I had thought! Thank you so much for this information! 🙌🏽 And thank you for responding with respect! I understand people have Their opinions but I wanted answers to my questions thank you thank you.
