I am considering applying for a fiance visa or a spouse visa for my girlfriend who lives overseas.

However, I have a concern due to a prior arrest. I was arrested, a little over a year ago, for what would fall into the category of dating violence. I was charged with criminal mischief in the fourth degree and for harassment in the second degree.  I received and ACD (Adjournment in Contemplation of Dismissal). My record has been sealed since the accident. Apart from my arrest, I am an upstanding citizen. I am college educated, and have a steady work history.

Is it likely my that my case will be denied because of my arrest? I understand IMBRA, and its intend to protect immigrants, but if the Fiance visa is not a viable option should I apply for a CR1 visa instead?  Please, advise.

Jeffrey Epstein also was college educated and had a steady work history.  He wasn’t an upstanding citizen either.

USCIS runs background checks on all petitioners, it’s part of determining eligibility to petition an immigrant.  If this conviction prevents you from petitioning a fiancee, it will also prevent you from petitioning a spouse.  The answer is it depends on exactly what the record says you did.

@Rob Beri:  you seem a little abrupt in your answers to everyone’s inquiries.  The reason people here want specifics is to assist in answering your question, not for judgment in your history.

My husband (fiancé at the time) has been arrested 3 times for drinking and driving offenses.  One was dropped, one was plead down to a non-criminal offense, and one was a misdemeanor.

It’s good that your fiancé is aware, but just make sure she knows the specifics of the event and what happened afterwards.  I WAS asked at my K1 interview what I knew about his criminal past.

As long as the nature of the crime isn’t serious, you should be fine, so long as your fiancée can answer the questions about it IF asked.

Good luck.
