My wife is a 10 year green card holder from China & I am a US citizen. We wish to bring my 30 year old step-son to the US. He has never been married & has never had any legal issues. We have filled out the G-1145 & I-130 with the requested information & supporting documentation. We are currently ready to mail to the USCIS for approval.

What other documentation, forms if any, do we need to send to assist with the approval?

So your wife, as an LPR, is sponsoring him, correct?

The main thing she needs is patience, this is a very long process. Looks like the mother is the one sponsoring.

Seems to me there is a lot more in this package than needed (like the photos). Your wife is the sponsor, assuming you didn’t marry before he turned 18. If it is a simple mother-son biological relationship, proving it is easy.  It will probably be 5-7 years before he is able to immigrate.

He has to remain unmarried through the multi-year wait for his priority date to become current. Is he aware of that?

No. The petition would be void if he got married.

If he gets marry, the petition is automatically void.  He must be single throughout the entire process and must be single when he enters the US on his immigrant visa.  


He can continue on with his life and have a family, but he can not get marry if he wants to immigrate to the US.  After he immigrates, he can return home to marry and file a new I-130 petition for his wife.

If your wife naturalized before he got married then the petition would not void, however, the category would change to F3 and add more years to the wait time - currently the difference works out to a little over 7 years extra wait time.

You do not have to 'upgrade' and would not if he was still single and the dates followed a similar pattern.
