Hello all, I just filed my K1f packet and got my NOA1. I am going to spend the few months in the Philippines with my fiancée for my second visit in 2 weeks. 


My first question is, when are RFE’s given? At the NOA2 stage? I’m really worried about getting an RFE while I’m gone, so I wanted to do as much preparation as I can while I’m still in the US.  
 

I currently do not have a high enough income to meet the requirements at my current job so I was planning to use my mother as my cosponsor. However, I have seen many different places say that the Philippines does not accept cosponsors? Does anyone know the real answer to this? 

If they don’t accept cosponsors, what should I do? I won’t start my higher paying job that I have lined up until I get back from the Philippines. 

If they do accept cosponsors, would *both* my mom and I need to fill out separate Affidavits of Support (I-134?) Or what forms does the cosponsor fill out?

your co sponsor will need to fill out the i 134 and if they file taxes jointly with someone, that person will need to fill out the i134a. You also need to fill out the i134.

 

at AOS state, the forms are the i864 and i 864a

 

I know for a cr1 PH will accept co sponsors. for a k1 im honestly not sure. I want to say no, but dont pin me to that.

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

RFEs are typically issued before the NOA2 but they can issue them at the interview as well, if they need something and it was missed

The Philippines does except co-sponsors. Funny thing is that for the better part of 3 years it's been hit or miss if they as for any financial information. I think the PI is a forward thinking embassy and they have come to the conclusion that the I-134 is not a binding contract so why fool with it. Let the applicants deal with the I-864 at time of AOS once married and in the states. Just my opinion.

 

Now that's not say they don't ask for it as on occasion they have so be prepared with the following:

 

EVIDENCE OF SUPPORT: You must submit any evidence which will show that you and members of your family who will accompany you are not likely to become public charges while in the United States. Visa petitioner (US Citizen) will have to complete form 1-134. If the petitioner does not qualify as a sponsor, a Joint-Sponsor should ALSO be presented (any US Citizen living in the US or Legal Permanent Resident), who will also have to complete form 1-134. Both, the Sponsor (Petitioner) as well as the Joint-Sponsor, will have to present last year's income tax return transcripts. W2 form and proof of current and sustainable income (e.g letter of employment on letterhead including salary and start date, most recent salary receipts, bank accounts, value of properties, etc.). RFE's are normally issued during the NOA2 phase. An RFE is nothing more then a missing paper or an answer that was missed on the form. When an RFE is issued then you are close to approval. The agent in their mind has approved your application BUT based on what you need to return to them is when they make their final decision. It will be based on the totality of what they have in front of them which includes the RFE.

Manila does accept co-sponsors with the K-1 visa, on a case by case basis.  The embassy does look for the co-sponsor to be immediate family (parents, siblings) so your mom is a good choice.

 

And yes you both need to complete the I-134, plus include a copy of your most recent tax return and W-2.

Thank you. When my cosponsor fills out the i-134, will I be listed as the beneficiary or my fiancee?

Just the beneficiary .. that is the person that needs to be sponsored. ;)
