If this is the case, I’d refile immediately and demand a refund from the initial application, they can’t charge for a service not carried out

Our only last chance is a second application through a passport courier agency, because he cant travel to a regional passport agency where they make expedited passports. Plus we have to wait for a birth certificate too.

Try calling them again today since they're open and ask to speak to a supervisor (I would think they would have one) and tell the person the situation.  Did the eariler contact person said that the application had been lost... and not denied or rejected? I hope that the supervisor has enough sense to understand why you shouldn't pay extra for a lost application. You can ask the supervisor to look around but then again your time is limited.
