Help - Affidavit of support Questions

Hi guys, new to the forum so I'm not sure if this is the right place for this. But I was wondering if some of you who have gone through this can help me out.

So, I have already applied for my wife which lives in Brazil. A day ago we got an email saying it was at the NVC so we received our case number and invoice.

We paid the fees so now we are just waiting for the forms to be available to work on. ( affidavit of support and IV ) 

 

I have been employed for the last year and a half, I make enough to sponsor my father(which I already have) but I dont make enough to sponsor my wife.

 

However my stepfather is willing to help me.we live in the same house but I do not financially depend on him. 

 

My questions are, would we have to put him as a household member or joint sponsor? Form I864 or I864a?

 

He has 2 dependents, my mother and brother. So would we have to put as if he has 4 in total? (Him,my mother,my brother and my wife)?

 

Also, he is not employed as of now, however his three last years he filed taxes. Would this be a problem?

since he is not employed, any of the other information is a moot point. He will need proof of current, ongoing income for it to be approved (or proof of assets if he is using those in lieu of income).

 

For reference, you could either file as a household member or separate joint sponsor on the 864. Youd have to play with the numbers to see which worked out in your favor.

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

Thank you for your response!! How long does the cash asset have to be in the bank account for it to count? I dont like to keep all my money in my bank account.

If you are going to qualify off of your assets + income, keep in mind that the assets has to be 3x the amount that you need to make up the minimum 125% guideline. And even then, it may still be rejected, especially if it just barely meets. It's ultimately all up to the consular officer

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!
