Negative. She came on a K1. No i130 is needed if she married within the 90 days.

No she was a K1(I-129F Petition). The married and adjust status. Now 2 years later they are removing conditions. That's what the I-751 is for.

AOS then... point being the whole immigration process was about proving bonified... if it’s all presented to support counter ex’s accusations of fraud it could possibly assist in getting the annulment changed..

Correct an annulment (American Version) is designed to wipe the marriage from the books completely  as though you were never married. It is used in cases of a spouse marrying under false pretenses i.e.  like the spouse was gay and did not reveal it to the other spouse or the spouse could not conceive etc. Thus USCIS denying the case because they were never really married.


4 years, 11 months, 2 weeks and 3 days

Citizenship Complete!

B rated Made for TV movie maybe?  I believe you, that a judge cannot rule without hard evidence.  Lets be honest, this is not a DIY case and really discussing it any more on VJ is a waste of time, but whatever floats people's boats!

Actually AOS for the K1 doesn't require much evidence, especially not 2 years ago.  Many people weren't even interviewed if they came over on a k1 and did the AOS at that time. I believe it was before the mandatory interviews.   All they had to show was intent to marry and met within 2 years to get the K1.  Occasionally there's relationship evidence asked for but none of it asks if you're in a sexually active relationship.

Yeah... I’m thinking there’s a whole lot more to this story than is being disclosed by the op... 

 

trust my, my ex was a real piece of s#it.... I was with him 15 years and as soon as we split, I swear a different guy. but one things for sure, it was all overturned due to lack of proof and unsubstantiated claims of bs... and the judge was his uncle... can’t get more onesided than that and still couldn’t discreadit my name..

@Joshiandmiri What country are you from? Another option (but would need an attny) is to file ROC under hardship waiver. Believe it or not but the hardship waiver does not require you to prove bonafide marriage. Its very similar to asylum. So depending on where you are from it may be an option. But you would have to qualify for the hardship waiver similarly to how you would qualify for refugee/asylum status. Is that something you think you may qualify for? 

 

The other waivers for ROC include divorce waiver - which you just went through or abuse waiver. It was posted about an alien who was able to qualify for VAWA with an annulment based on fraud. Interesting as that might be, VAWA does not apply here as you have a greencard and are applying to remove conditions. The abuse waiver ROC is part of VAWA laws however it requires you to prove both abuse and a bonafide marriage. 

 

Once more the best thing you can do right now is look into getting the annulment appealed if possible. Reach out to probono or advocacy groups in addition to getting free consults with top local attnys.  If you are going to remain in the US to try to figure this out you can go get a 551 stamp of status. You will be an LPR until a judge strips it from you, so you can and should get a stamp as that would be your only proof of status.

My ex testified all the bad things about me, including not eating dinner together even if I had bank statements showing charge in restaurants for two, for two years.

I know this is hard to believe, but it happened to me. My ex is a psycho and did a lot of bad things to me: stole my money, broke my phone, threatened me with deportation, blackmailed me, took advantage of me ( he didn't work for 16 months) and threatened I needed to pay his loans and credit cards. He lied in the court purely for revenge.
