I received the date for our interview for the K1 visa for my Cuban fiancé and wanted to reach out to you for help. 

 

He did a mission in Venezuela as a music professor for three years. As he was there on a mission, Venezuela has no record of him as a resident and can’t provide the antecedentes penales/ police certificate. (Similar to a soldier being stationed abroad). Has anyone else had this issue? What did they supply? If not, any ideas on how to get the answer for this issue? We do not want to get to Guyana's American Embassy for the interview and get Administrative Processing or denied.

Was he given any cedula(ID) number in Venezuela? you can request those using the passport number. However,I'm unsure how it will work for a foreigner.

Thank you for your quick response! Unfortunately (and fortunately) he is back in Cuba now and was never given a venezuelan ID since he was never considered a resident there.  We tried that website and couldn't request the antecedentes penales as it requires the venezuelan ID number.  Any other ideas?

I'm not familiar with how things work in Venezuela, but just throwing this out:  would there be any type of electronic record of his arrival and departure?

Nope. That doesn’t exist in Venezuela. And much less for Cubans who go there for cultural exchange.  Something similar has existed for immigrants though. All my grandparents had a document called “datos filiatorios”  that would show the date,place of arrival,Birthdate,country of origin, and full name.  In that case, the person need to be present in the country to request the document or leave a power of attorney to someone to act on his/her behalf.

Try contacting the Venezuelan embassy in Cuba. They might be able to provide you with a similar document.

Forgive me as I am not that knowledge with some of the terms being discussed here but I have some information that may or may not help. The V embassy P3 letter states the following in conjunction to PC.

 

Police Certificate: An applicant must present a police certificate, if obtainable, from his or her country of current residence and country of nationality, if residence in such country exceeds six months. Police certificates are required from countries of previous residence, if residence there was for more than one year. Please note that for Venezuela, we only accept police certificates that are issued by the Ministerio
del Poder Popular de Relaciones Interiores, Justicia y Paz. We cannot accept police certificates or certificates of good conduct from any state or municipality. Please consult the Department of State web-page for any questions regarding obtaining a police certificate.

The police certificates in Venezuela are only for venezuelans and foreigners with cédula (ID) and resident Status. Cubans who went there as part of a  cultural exchange can't obtain it. In Venezuela, we get those by registering on a website and then downloading them, once they do the background check and the certificate has been approved. I'll link the website below(because I know you're always super helpful and keep this things for your records)

Have you tried requesting the police certificate with the cuban ID? I know things are much easier here in the EU and probably not comparable, but I requested spanish and french police certificates using my german ID with no problem. As I understand it all they are doing is certifying that no crimes have been committed in the country by the holder of that id, no matter what nationality that id holder has, when they were in the country and for how long.

At the very least, if you request the police report and they turn you down in writing because you haven't got the right ID you can then take that letter to the interview to proove you made a genuine attempt to obtain a certificate but couldn't, I suppose?
