Affidavit of Support Question

Hello,

 

Hope you can help me. 

 

I can across this question. Scenario: 

                 1. Income = $40k - W2 2018

                 2. Tax Transcript 2018 - $25k

 

To save tax, Mr. yyy put money in 401k pre tax. Mr yyy works for a cab service as a cab driver full time.

 

Since the %125 poverty line is $22k for a household of 2 and the Tax transcript is borderline : $25, is this a problem? Or would $40k be considered?

 

Does this person need a joint sponsor? The person is already Documentarily Qualified and expecting interview in Mid-Dec.

 

It would be great if you could help.

HIs W2 will show the 401 k  contributions but in this case ,  i would put the assets (and proof from the investment company) in your AOS  I 864

In 2019 he is allowed the max of $19000 for 401 K so this is good
