VISA DENIED, INSUFFICIENT EVIDENCE

Timeline

My fiance just had her interview in Guyana on June 4. When I was there back in April I filed an application for my birth certificate and we still haven't received it. Also, she didn't have a certified copy of my 1040. I sent her the 1040 and the only thing we're waiting on is the BC. They told her when she gets all the necessary documents to mail them to the embassy. Do they call her in for another interview or do they make the decision on their own based on what they receive???

hmmm...i would call USCIS for that. You should of waited until you gathered ALL of your documents. Two reasons: #1 Why risk everything for trying to be quick. and #2 Vermont is the fastest service center compared to CA's. So you had nothing to lose and now there might be a delay with that.

02/09/09 AOS package send Express Mail

02/10/09 AOS package received and signed.

02/17/09 NOA reciepts

02/23/09 NOA about March 3, 2009 Biometrics

02/28/09 FRE!!!! :(

03/06/09 Biometrics completed

03/30/09 Responded to RFE next day air to Lee's Summit, MO.

04/25/09 AP and EAD card arrives

07/10/09 Interview letter arrives for 8/19/09

08/09/09 AP letter used to re-enter the U.S.

08/19/09 Interview completed. Results in two weeks. ( I think we got it)

08/24/09 Letter in the mail stating Interview Approved. Welcome to the United States!

your post is missing alot of detail. did your fiance get a denial letter and what did it say?

if she is NOIR/ NOID then the petition gets sent back to USICS. just like ours did :(

I agree, more information would help anyone to answer your question. My guess is she got a blue form called a 221-G. If she did if you mail in the information they ask for you will get your visa without another interview. Make sure you have it and in to them within 60 days or your situation will turn into a denial and your file will go back to NVC where you must file an appeal that will take a year.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.
Waiting - Waiting - Waiting
3/6 Called NVC file sent to Washington for "Administrative Review" Told to call back every few weeks. 7/6 Called NVC, A/R is finished, case on way to Moscow. YAHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

I'm sorry, but the USCIS has nothing to do with the case between the time the petition is approved and forwarded to NVC and the visa issue. If you want to call somebody, call or email the Consulate directly.

Generally there is no second interview. You just submit everything they ask for according to the instructions they gave you, and wait for them to inform you of any next steps. Hopefully, the next steps will be to get them her passport so they can issue the visa.

You mention a certified copy of your 1040. There really is no such thing. I suggest you obtain a tax transcript and send or fax her that instead. Just google "tax transcripts" for information on how to obtain them. They will fax them to you for free. You may want to consider getting the last three.

If you send a tax return instead, it needs to be complete with copies of any W2's and/or 1099's, not just the "1040". Did they ask for a 1040 or a tax return? Now is the time to read and comprehend precisely and respond accordingly. Your future is in somebody else's hands right now, so as difficult as it might be, you must live by their rules.
