I am a Pakistani citizen and I filed my AoS application in September 2019, and had my biometrics done in October 2019. I recently received an RFIE that asked me to submit my long form birth certificate, which I do not have. I had filed a Family Registration Certificate (FRC) with my AoS application, which was in English and contained all the information that the birth certificate does. The FRC is an acceptable alternative to the Birth Certificate as mentioned by the State Dept Reciprocity Schedule here (State Department Reciprocity Schedule). USCIS also says that it will accept whatever is in line with the State Department's Reciprocity Schedule. 

The RFIE has asked me to either provide the long form birth certificate, OR 

 - An alternate secondary evidence, plus 

 - A letter from government or relevant authority explaining the reason my record doesn't exist. 

 

I am really in a bind here. At first they say that the document is acceptable, and then they send an RFIE. Should I respond to the RFIE with an explanatory letter from the Pakistan Embassy in DC and send prints of the link above to back it up?

I would suggest resending the FRC along with a print out from the US State Dept website explaining it is an acceptable alternative as you intend to.

 

make sure on the FRC print-outs fromthe State website you highlight the pertinent areas.

 

if you can get any information or letter from the Pakistan Embassy that confirms that the FRC is accurate and the record doesn’t exist, that will help too.

 

you have approximately 87 days to respond to the RFE. Good luck.
