Hi All,

My fiancée is a USA citizen and wants to file for the mum who currently has a multiple 2yrs visa. Would it be advisable for her to be in the USA while petitioning for her when visiting or when she returns to Nigeria ?

Does not matter where she is, sooner the application is sent in sooner she gets an immigrant visa.

She cannot enter the US on a B visa with intent to adjust status.  That is immigration fraud.

File ASAP. Visit as usual, return home on time. Don't spend too much time in the US (just as she would if she wasn't immigrating eventually).

No reason to wait to file.

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

?the mere act of having someone file an I130 does not void a visitor visa. Plenty of people with pending petitions have visited.
