My fiance' was just denied his visa at his interview yesterday so if I go there and get married, what type of Visa would I apply for once I return home??

If they denied because they didn't believe the relationship was real, getting married and filing another petition isn't gonna make them automatically believe it. So many people have done that.

It's not just that, I would have to go back to visit again anyway to meet the time requirement of last seeing each other so we figured why not. I did consult a lawyer and even though a lot of people do that, the chances are better if married even though there's no guarantee. We know what we need to do and submit, just decided to be married this time around.  Yes, so many do that and a lot of them get approved just as well as a lot of them don't. Thanks, hoping someone answers the question on the Visa type I would have to submit, that's what I'm needing information on.

CR-1 spousal visa.  Follow the Guides on VJ.

What was the reason for the denial?   Any red flags for immigration?

Thanks! No red flags for immigration, just not enough evidence of relationship BUT we realize our error. I was going by the instructions for the K1 and the letter I received once our application was received and approved. It listed my fiance should take with him our correspondence, pictures, etc. so I did not include any of that with the application. When he went for his interview they did not ask to see it and my fiance feared debating with them not knowing if he would cause for them to do something to make it more difficult for him to get future approval. So, this time around we plan to be married AND I will submit EVERYTHING with the initial application, I don't care if it's a novel long worth of documentation!! I really can't be upset, I'm sure they reviewed everything prior to his interview and not seeing that stuff made a difference. They could have asked him though if he had any evidence on him, but I guess that's too much like doing the right thing and helping someone out. Oh well, we're not stopping so on to the next phase...

Above is the type of visa you file, however, it would really help us give you additional advise if you let us know the denial reason so things can run smooth for the CR-1 process. Best wishes!

Edit: Nevermind you were typing at the same time i was lol

How much evidence did you produce?

I want to know how much they consider "not enough".

Thank you in advance.

Instead of trying to hijack someone else's thread, proper forum etiquette would suggest that you post your question in your own new thread. The OP left out a few salient points, as did you. For example, one of them being, the location of the interviewing embassy/consulate. If you post your own question, other members would likely respond with some useful tips.B-)

Good luck on your immigration journey.
