Petition For 20 Year Old Daughter

Hi Joijoi! Glad that you are able to file for your daughter. I think the best thing to do is wait for her to have the baby and go from there. And I would agree with the other/s here in saying that no marriage yet till she gets here in the US.

 

Do you have any idea how long is the process since you are a LPR and not a US citizen (yet). I'm asking you this coz I'm going to file for my daughter this month and I'm also a LPR.

How long depends on 1) how old is your daughter and 2) what country was she born in?

Hello everyone! I would appreciate all your input . I'm a LPR for over 7 years and filling papers now for my naturalization and petition for my 20 year old daughter . I wonder if it would expedite her papers if I would become a US citizen while her papers are in process?

Hi Aaron! Sorry I forgot I dont have anythin in my profile yet. My daughter is 20 and shes in the Philippines. I actually just posted a new topic. But whatever you can share id appreciate it.

You can not expedite her case.

 

If you become a US citizen before her 21st birthday, then she will become an Immediate Relative of a USC and she would get her immigration visa within a year.

 

If you become a US citizen after her 21st birthday, she will have aged out of the F2a category into the F2b category and her case would change to an F1 family preference case.

 

Then CSPA comes into play where she could retain her place in the F2a category.

 

Yeah, it can be that complicated with her aging out at 21 and you trying to naturalize during this time.  

When will your daughter turn 21 - exact date please?  Have you filed the N-400 for naturalization yet?

Hi Elle! My daughter's in Philippines right now. And she's 19years old. And i'll take about 2-3 years before your daughter gets here in US.  
 

 

In your case it looks like your daughter will be over 21 before she gets here! And I heard when they become over 21, it will be hard for u to bring here in US.

Thank you so much ! My main concern is to petition her before she turns 21.  Life was kinda crazy the past years and its only now that im settling down. Appreciate all your help.

As an LPR, you filing for her before her 21st birthday does not prevent her from aging out into the F2b category where the wait is 5-10 years depending on the country of her birth.

My daughter turns 21  on  December 18.  YEs a week ago. Thank you for all your help.

There’s no way you will naturalize before she turns 21. It will start off as an F2B petition, becoming F1 when you naturalize. For Philippines currently there is only a one month difference between the wait tome for these categories, both about 11 years.

Maybe I should have been more explicit about what i said, as your previous question asked about what happens if you naturalize while its in process. That barely affects it, but if you had naturalized before she turned 21, it would have made a huge difference.  Seeing as you won’t, it doesn’t really matter.
