Hi

My husband is USC and I am from S.Korea and we both have been lived in Stockholm for 10years.

We are officially reported as a marriage couple in United States and S.Korea but not in Sweden.

Still I believe we can filing up CR-1 visa from Stockholm anyway.

I heard that we can send doc. to Chicago or directly to Embassy in Stockholm, but if we go through Chicago - it takes about 2 years at least as I heard, not sure it is true or not though.

Does anybody know where we should send the doc. ? or can we filing the doc. on online which is new service opened about 10days ago?

 

since we are expecting a baby soon, I don't want to be separated with my husband more than 6 months..

(heard pregnancy is not a case for DCF.)

You just need a valid marriage certificate.

DCF is not generally available for Sweden. You will need to file in the US. DCF requires a local USCIS field office (https://www.uscis.gov/about-us/find-uscis-office/international-immigration-offices).

Edit: the rough processing time is closer to a year or so, not 2 years.

There is a case for exceptional circumstances for DCF, although nothing you noted falls under this.

You can file online if you prefer.

You can remain together through the process. The petitioner will need to either have US domicile or show sufficient intent to establish US domicile prior to the visa being issued. He will also need a means for sponsorship - either a job in the US, a job abroad that will continue upon coming to the US, via assets, or via a joint sponsor.

Husband also needs to have filed US tax returns for the years worked outside the US (last 3 will be needed for immigration purposes)

over $100,000 is tax exempt but be aware of the term "stacking rule" which is explained best by the following site

you,  the S Korean will also need criminal report from home country and Sweden at the NVC stage
