Wrong SSN and address of sponsor in form I-864. How serious is this and how to fix it?

Hello,

 

I'm an F1 student who just got married to a US citizen and he's sponsoring me. We're both in grad school, my husband worked for a couple years and now just got offered a Phd research position. We're currently living in different states due to school but we meet each other twice a month and I'm going to spend Winter break with him.

 

The immigration lawyer filed and filled out all the forms for us, the entire AoS packet was sent to the Chicago lockbox on Oct 30. I have not received any receipts yet. I was a bit concerned so yesterday I requested to review the application info again and lord and behold, the legal assistant made an error in form I-864 in typing my husband's ssn number (repeated a digit in the middle twice and left out the last digit). Beside that, his ssn in form I-130 is correct and we also include his tax transcript of 2018. His street address, city and zip code are correct but the state is not (VA not TX). Needless to say I feel very upset over this, I find this very unprofessional. This is not the first time I had to correct her and she was rushing me when I wanted to review in details the application before it was sent out, she assured me it would be double checked by the lawyer again. I sent an email to the lawyer past midnight yesterday when I just found out and so I'm still waiting for his response on this.

 

Put that aside, my main concern is I do not want to delay or jeopardize the whole process. How serious is this typo mistake? I have not received case number or the receipts yet so how can I fix this? I imagine the sooner the better before they proceed to something else right? 

 

Please share with me your experience or your knowledge on this. I'm so worried right now, I can't even focus on studying. I know the EAD takes a while to process and I really need it to be able to work :(. Thanks a bunch to whoever comments.

I would just let the case progress and fix it at the interview. It is not a big deal

Hello thank you for the reply! I checked on the USCIS website and they say they may use the SSN filled there to verify if my husband is qualified to sponsor me so I'm just very nervous about this. Do you know if such is the case and would they deny my application because of this?

You might get an RFE for the I-864 as each form is processed separately. I received an RFE for my I-864 as I missed to check a box. Don't worry about it and when you do get an RFE, just send the updated form.

Thank you for your reply! Did it delay your process significantly? Did you redo the entire form or just submit the pages that applies? Also it's been almost 3 weeks now and I still haven't received the receipts yet, I don't know what the issues are.

It probably delayed the processing of my application by 2-3 weeks as it took a week for the RFE notice to reach me and another week for my reply to be registered in their system. I sent the entire form filled again with a few supporting documents from my employer which i missed before.

Did you not fill the Form G-1145 to get e-Notifications about your application? I got a text as soon as my application reached USCIS and another notification when they sent out the receipts which was within a week of my mailing the application.

Unfortunately my lawyer did not fill that form for us and I had no idea about that form. I'm waiting for my case receipt so I can track it on the USCIS website. Did you have to pay extra fees for the RFE and correcting your info beside the mailing fee?

Ah! That is very irresponsible on the lawyer's part as any seasoned immigration lawyer should know that the form G-1145 is very important for updates and notifications about your application. There is no fee for the RFE. USCIS sends a letter explaining the RFE and documents they need to move forward with your application. I would have advised you to call USCIS to check the status of your application but without a receipt number, I am not sure if they will be able to help you out. That is why G-1145 is so important because USCIS will send you a text with your receipt number and updates about your receipt being sent.

Oh gosh, yeah I feel quite beat up over this kind of unprofessionalism. I might as well could have done a better job researching on here and do it by myself at this point.  I can just follow up on it later with just the case number after they send me one right? I hope that's the case! I'll just try calling USCIS and hopefully they can identify my application with my husband's info and my info :(

Once you have the notice, you can followup with the receipt # on the USCIS website or any app that keeps tracks of your applications. But 3 weeks is kinda borderline late to receive the notice. It usually takes mostly 2 weeks from the time USCIS receives your application. I got the text update 3 days before i got my notice in the mail.

 

USCIS uses usps to send out the notice and there have been reports of usps loosing the notice but in your case I am guessing you must have filled out the concurrent I-130, I-485, I-765 and I-131. So, loosing 4 notices is highly unlikely.

I just called USCIS. They actually gave me receipts on Nov 12! They are being sent to me. So I was able to get three receipt numbers for I-485, I-765, and I-131. I just added the receipt numbers to my USCIS account and now able to track them! Not sure why they haven't mentioned I-130 yet but she said they have received all four, just the 130 will be under my husband's name?

Update:

My lawyer replied back. He said it should not cause any issues in processing the application so the best option for now is to wait till interview to correct or if they notice and send RFE, otherwise the application is mostly based on the relationship of the marriage, and my husband's status as a US citizen. I've been asking on forums and seems like the consensus opinion is this is minor, I hope it is really the case.
