Hi,

My wife and I have recently had our I-130 petition approved and we're waiting for it to be shipped to the NVC! But we're a little nervous about the I-864 Affidavit of Support. I took some time off from work this year to focus on school and to visit my wife including for our wedding in February. After, it took me a while to find a job and I've only been working since the end of September. I think I can get a letter from my employer but I won't have six months of pay stubs. My current annual income is less than required but my income in 2020 will be more than enough. My 2018 taxes will show enough income as well.

 

If things go slowly and I submit the I-864 after the new year, is it ok to not have 2019 taxes filed yet because they are not due? I'm not trying to be sneaky but showing my 2019 taxes won't help me. Can anyone who has been through the process help me on if my I-864 will be accepted? With a letter from my employer will my low current annual income be acceptable? Is it much more likely to be accepted if I submit it in early 2019 with a much higher current annual income? Should I submit what paystubs I do have? Or does that just draw attention to the fact that I haven't been working for six months? Thanks in advance. Any help is greatly appreciated.

NVC requests the MOST RECENT tax return/transcript, not 3 years.    2018 IS your MOST RECENT tax return.

 

With a new employer you may want a letter from your employer and copies of pay statements.

 

 

"If you completed Form I-864, I-864A, or I-864EZ submit an IRS tax transcript from the most recent tax year, which NVC can process more efficiently than a copy of a tax return.  Alternatively, you may submit a copy of a tax return from the most recent tax year."

Yes I won’t submit 2016 and 2017. I filed the taxes but I didn’t make a lot of money those years. I make above %125 now.

 

Ok good. So that answers my question that 2018 will still be the most recent tax return. Thank you. And for the other information too.
