Hello,

I'm a bit confused about the rules to obtain the ITIN for my spouse living abroad who has never entered the US.

Has one of you done this before? Which documents did you hand in along with your tax return and their W7?

you follow the innstructions for the W7

1st get a POA from the alien so you can fill out the form and sign this and tax returns or that person needs to fill out the W7 and sign for themself

2nd  you need to copy of your marriage certificate

3rd you need either a passport or national ID or birth certificate to show DOB and age

these get mailed with the paper return in the spring

Thank you both @aaron2020 and @JeanneAdil!

So a PoA, certified passport copy, and the original marriage certificate with translation will hopefully do it.

Do you know if the passport copy needs to be stamped by the ministry of foreign affairs in his home country? And the PoA as well?

If he has someone to certify it,  it can help but it is not asked for

and send the original and the translation of the  supporting documents
