cr instead of ir

I have been married to my husband for more than 2 years. However, when we started the papework, it was just a year. When I went to the interview, we have been married for 2 years and 3 months. I specifically asked the officer, what type of visa I would get, SHe said that I would get IR-1. I got my visa today and it says cr-1.

What to do now?

If i do end up going on CR-1, when should I start removing condition? Right after I arrive or only when I am in US for 1 year and 9 months.

Please help, I am sooo confused now!!! :help:

Many who have a CR-1 visa when entering the country they show the officer at POE that have been married more than 2 years, the POE officer will code the system to generate a 10 year permanent residence card.

Some if very close to 2 year wedding anniversary before entry to the USA delay entering until after their second wedding anniversary just to have the POE officer to code for a 10 year card.

If generates a conditional one it will be valid for 2 years, and filing to remove the conditions would be allowed 90 days before the 2 year expiration of the card (1 year 9 months).

March'07 NOA1 date, case transferred to CSC

June'07 NOA2 per USCIS website!

Waiver I-751 timeline

July'09 Check cashed.

Jan'10 10 year GC received.

Hi there!!

Yes, I am in the same situation you are!! We had been married more than 2 years at our interview. And we were confirmed this with the Vice Consul who interviewed me. She definitely said we qualified for an IR1 because we had been married more than 2 years. HOWEVER, when I received my passport last week it said CR1. We had no time to change it.

SO we decided to enter the US through San Fransisco this morning and just show the Customs Officer our marriage certificate. He didn't want to look at it and said if it was a clerical error we had to contact our local immigration office and change it through them because it was a matter for the Department of State. He said he could not change what the Sydney Consulate had written. Boy were we pissed off!! We also noticed on the front of my brown envelope my husband's mailing address was wrong and it was written on all the forms we submitted throughout this whole process! That mistake the customs officer could change. But right now I am so pissed with the Sydney Consulate and their silly little clerical errors and their non US citizens employees who don't know much and tried to recommend refusing my visa because of an assumption she made!! Will be writing them a letter of complaint!!! :angry:

So, we wil now be going to our local USCIS office this week and solving this problem. Don't enter through SFO because of my experience!! Do a search and see which airports have changed it for others in the same situation as us! Also, the customs officer never gave me an expiry date, just an entry date. This confused my husband and kept asking for one but the officer just said all customs officers will know the expiry date! But I would like to know the date too!!

06-01-07 INTERVIEW

06-04-07 Received VISA in the mail. Silly Consulate issued me CR-1 instead of IR-1, no time to change it in Australia, will try to change it once in California.

06-10-07 POE SFO

06-21-07 Receive SSN#

07-12-07 Receive Green Card in the mail STILL HAD CR1 INSTEAD OF IR1

12-10-07 Finally sent I-90 asking for a new green card with correct info.

06-17-08 INFOPASS - Was told USCIS sent new green card to old address back in Jan. Will resend it but may not be able to correct error as it was made by Consulate not USCIS.

What to do now??

It was a different issue but the immigration official at LAX royally screwed up my wife and daughter's passports as well as letting them keep the sealed envelope. I made an infopass appointment, where they took the envelope and sent it to the local Customs and Immigration manager. He was out of town at the time, but I phoned him directly upon his return, sent him the passports and he straitened everything out.

I take it your main issue is with USCIS and getting the correct green card but you may also have a passport issue. I doubt you need an exit date when you enter with a CR1 visa. You do with K3. If you think something is not right, you can contact your most local POE to get help resolving it.

Facts are cheap...knowing how to use them is precious...

It shame you already bought your tickets to SFO! Be optimistic you may get lucky and have a Officer you will change it for you!

I will take Pushbrk's advice and make an infopass appointment hopefully for this week The Officer said we shouldn't have a proble getting an IR1 as long as we can prove our marriage is over 2 yrs old. So I'm not too concerned. It's just a hassle for my husband to take an afternoon off work so we can drive an hour to prove our case. But at least it should get fixed! I will definitely keep you updated, as I can understand your stress!!

Also, I tried looking at the link you posted. But it is in Russian and I do not understand Russian. Would like to, it is a beautiful language but some people say it very difficult to learn.

I will take Pushbrk's advice and make an infopass appointment hopefully for this week The Officer said we shouldn't have a proble getting an IR1 as long as we can prove our marriage is over 2 yrs old. So I'm not too concerned. It's just a hassle for my husband to take an afternoon off work so we can drive an hour to prove our case. But at least it should get fixed! Just tried making an appointment. Our nearest office is about an hour's drive. Unfortunately. infopass gave us an appointment in LA, thats 3.5 hours away!! I am so mad right now, I will definitely be contacting the Sydney Consulate and asking why they messed up my visa classification and how could they could get my husband's address wrong when the correct address is written on all the forms they should have looked at and checked!!

I hope you get IR1 at your time of entry into SFO! What a waste of time and money now because of a clerical error!!

You don't need an IR1 visa, now. You need a ten year green card. USCIS doesn't issue visas.
