My husband lived with me for a year and 4 months after we got married. He got back to US July of 2018 and immediately started working. So he filed for the 2018 tax covering the months from July onwards. If he worked the complete year, he would meet the income requirements set by NVC. We have all the documents - Certificate of Employment and a letter from the employer, a letter explaining our situation why we didnt meet the full 2018 tax year. We also have the 2015, 2016, and 2018 irs tax transcripts. We don't have the 2017 because he was living here in the Philippines. He did not meet the minimum tax requirement to file in the US for that year. Is it still necessary for us to have a joint sponsor? Thank you.

you still have to file taxes even if you will not owe anything. You can amend or possibly write a letter explaining why you did not file. If it were me, i would simply file a return for that year. Technically, I dont believe they REQUIRE 3 years of tax returns (though I did provide them, as well). perhaps if you are self employed they do

 

you may want to have a joint sponsor lined up to be on the safe side and to help alleviate any stress of wondering 'what will we do if they deny us'. We make really good money (far far and above the requirements) and I was stressing about it and asked my dad - JUST IN CASE (and yes, i was being paranoid, there was no reason for us to have any issue, and we did not LOL). i felt better once he said ' youre crazy because yall make more than i do, but yes if you need it i will'. LMAO.

 

also for reference when we filed the petition, i had only been at my job 6 months, and when we had our interview, my husband had only been at his for...4? they did take his paystubs and employment letter but did NOT take the updated 864 (I had changes) and the new 864a since i added his income (wasnt necessary, but like i said, i was paranoid). That too, made me paranoid (maybe more so ' WHY DIDNT THEY TAKE THE NEW FORMS? WHATS WRONG? I TRIED TO GIVE IT TO HER TWICE!!!' ) but it was of no consequence and we were approved the next day.

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....
