Hello,

My question is a bit peculiar and quite specific. My current job requires me to visit the US a few times a year. I intend to stay with this job until Summer 2020, which is when I would leave for the US with the K1 visa to get married to my fiancé and start our new life.

 

However, my petition expires soon and I feel like I have to book an interview date before it does, for it not to be considered abandoned. Is that right? My case is ready, I already paid the visa fee and the US consulate in Paris' email just stated to bring a letter confirming intent to marry on the day of the interview as evidence to extend the petition. But I don't know if that works only if the interview has been booked within the petition's validity period.

 

Because of that, I might just book an interview date in February but I have a business trip planned in the US in March and probably another one in May. Obviously, I wouldn't be able to use my French passport as the K1 would be printed inside it. So here is my main question:

I happen to be a dual citizen of both France and Italy, two VWP countries. Is it legal for me to apply to ESTA with my Italian passport and do my business travel with that passport all the while the K1 visa patiently waits inside my French passport? Would that cause problem for the K1 validity? My current ESTA is with my French passport but expires soon. I will also have to renew that French passport for the K1 visa as it will have less than 6 months validity by then. 

Another solution would be to book an interview now and then reschedule it after my travels via the https://ais.usvisa-info.com/ website but I don't know how easy/complicated this is. Any feedback on this as well?

Thank you for your reply. However, my question is about entering with a different, also eligible passport, one that would not contain the visa and thus avoiding getting the process kicked in. And keep the visa in the other passport until I am ready to use it. If that's not clear:

- Getting the K1 visa in my French passport and not using it, keeping it aside
- Going on business trips with my Italian passport / ESTA
- Finally entering the US permanently with my French passport / K1 visa
