K1 refusal :( Suggestions

Every couple has their own priorities, and each couple must decide which visa is better for their situation.

K-1
    Slightly faster arrival in the US 
    More expensive than CR-1    
    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
    Spouse can not leave the US until she/he receives approved Advance Parole (approx 5-6 months)    
    Spouse can not work until she/he receives EAD (approx 5-6 months)    
    Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
    Spouse will not receive Green Card for many months after Adjustment of Status is filed.

  

CR-1
    Slightly slower arrival in the US 

    Less expensive than K-1    
    No Adjustment of Status(I-485, I-131, I-765) required.    
    Spouse can immediately travel outside the US    
    Spouse is authorized to work immediately upon arrival.    
    Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
    Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.

    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I never said that I wanted to depend on government's money, I have a good paid job in my country and saved good money that I wanted to bring with me, and my fiancee works too. 

I know if live there, I wont be having the income as I have here for now, but I intend to work there too and who knows might get paid well there too.

Something’s wrong here.  I was on the phone to the embassy for a lot less than this LOL

That's why I am wondering whether I should contact them to request for an answer or the refusal status on website is the final one?

Your sponsor should contact them.  Not you.  This is between the petitioner and the embassy.

Now I am scared to ask how long it could take for cr1?

For k1 we have applied on april4, on October 8th I was interviewed

Per other VJ members, the average time from filing to interview is 432 days.

We thought about it too, but I didnt know what would be the best. 

To contact or not, to wait for their letter  but we would miss a valuable time

Well, like Forever for me. Considering that I was never married and soon will be 38 and want to have a family and a kid 😭😭

You need to contact them BEFORE the petition leaves the consulate.   Once the petition leaves the availability to reconsider stops and you have no further recourse

Yes, I understand it. And as they never contacted and I found out that they refused today on the website put me under shock. And no one knows whether they still keep it or the package already gone ((

But your advice means a lot!

Will I need to show k1 denial reason in cr1 packet? I just dont have the answer from the embassy, only status change on the website 

embassy no longer has your packet / it has been returned to USCIS so they will not know (or remember)

only way you will know the issues is thru the beneficary (what happened in interview?   )

some here get a denial notice from USCIS

we never got one (2009) and I am still waiting as i requested it formerly 

 

don't really need to know Co reasons / just marry and apply for the CR1 to show you are serious and in this relationship for the long run

have a good application packet showing you 2 know each other well

When I was in a similar situation,  I requested the reconsideration within a day or two after the denial.   It took them a week to respond

Maybe,  maybe not.   Certainly wasn't immediately gone for me as I got them to reconsider.

 

Caveat is different consulate

Was going to mention is the most valuable time in the whole relationship right now is the time between refused and when the petition is sent back.

I am so frustrated now, the comment before you states it's returned to uscis.

But I tend to listen to positive comments likes yours

Maybe still cant accept the facts
