Ideally would have been better to post it on your existing thread since the bulk of replies from members already familiar with your circumstances could see your clarification.  Mods will come along shortly and merge the two, likely.

Hopefully you hear something soon, either way, so you can continue to move forward.

I did comment there as well---and asked  Mods to merge both threads, not sure why you started a second one, as it betters serves members to be able to better advise you when all info is kept in one thread.

He actually started two more threads but I moved one to the duplicate thread folder.

They have been merged so there is only one now, this one.  A third without replies has been removed.

Ok but I think new reader wont be helped from it. Mainly readers read main thread then go through comments. In future many readers might be related to my new detailed  thread (merged now) but its been converted to a comment. In thread I Have written in details what i have done for the appeal and all. And will continue updating whether my case gets denied permanently or not. But im old thread most of the comments were against appealing. But i have appealed. So I am not sure if ur descion of merging these threads is a right choice or not

I would suggest to edit this thread's main post and paste my new thread there (same thing though but in details)

Case Was Denied

On October 9, 2019, we denied your Form I-130, Petition for Alien Relative, Receipt Number WAC***********. We sent you a denial notice that explains why we denied your case and your options. Please follow the instructions in the notice. If you do not receive your denial notice by October 24, 2019, please go to www.uscis.gov/e-request to request a copy of the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

Catagory : f2b and f2a

They Wanted Additional documents to prove relation with petitioner such as birth effidevit, school cert etc and told to do dna voluntary.. We just sent documents and didnt do DNA . now case was denied. What will they ask now any guess? if they ask dna its fine. or they will ask anything else or do we have to appeal or anything ?

Ancestry DNA test is $49 and about 4 weeks results.

What kind of appeal did you file? There are 2 types, one is a motion to reopen and the other is a motion to reconsider. Regardless it seems your attny is continuously giving you bad advice and subsequently collecting money to fix issues they didnt address properly. First they advise you to not do the DNA and now they are charging you to file an appeal to try to submit DNA but didnt actually submit the DNA with the appeal- just a note saying its being done! 😮

The motion to reconsider is filed when theres a claim of incorrect policy. Motion to reopen is when you are presenting new facts. You did not actually present any DNA (yet) so all your motion contains is the affidavits and school records. Depending on how the new affidavits were written and the quality of the other evidence you did send you may be successful but I cant say the odds are high for it being successful. I agree with Goingthrough that they are not going to hold your appeal until you get the DNA results. They will consider your appeal with only the items you sent with it and not consider promises of DNA being sent nor wait until you do send them.

Perhaps the mods can edit your thread title to something that reflects an appeal was filed?
