Another lawyer opinion. Can old priority be retained?

That online lawyer suggested to refile again with the proper documentation if denied----so there's that option for you, as confirmed once more.

You can REQUEST that the old priority date be retained, as he suggested, however they are not obligated to.

He seemed more concerned about getting a positive rating from you, nonetheless.

It's very strange for you to be double-checking your lawyer with online lawyers, and then coming here to (mostly) non-lawyers to double check what the lawyers that are double checking your paid lawyers are telling you.

Just to inform u. One of my frnd got denial yesterday though he did dna testing result was 99.96%

This is very strange. What exactly is the reason and what exactly are they looking at. It will be hard to make any comment without knowing his full case.

This also makes me scared as my birth certificate along with millions of other in my country was registered late as Birth Certificate only started since 2008.

This thread is bogus. Sorry, OP,  I think you are trolling.

First it's "one of my friends got denial letter" - and his DNA results were "99.96%" - What did his denial letter say? You never told us.

Then another friend is denied but hasn't gotten the denial letter and his DNA results were 99.9999999999996% but hasn't gotten the denial letter yet.

If DNA test was legit and done through AABB laboratory, then there is no way I-130 was denied for your "friends"

Come on.

Helpful hint: you can quote 3 posts and just give one answer to all of them at the bottom without repeating it for each.

I have no idea how the reports actually show the results, but interestingly the 99.96% would in fact be denied:

DNA paternity and maternity (father-child/mother-child) testing reliability has advanced to the industry-accepted standard of 99.99 percent......Consular officers may only accept test results reporting a 99.99 percent or greater degree of certainty with respect to paternity/maternity as sufficient to support a biological relationship between a parent and child ...

No. I have actual lawyer in USA.

Im taking second opinion from JA

Yah lets see what happens.

This is what makes it so funny to me. Because you keep talking to people but expecting a different response from the same scenario you are putting forward. You have had two lawyers, not to mention the online JA lawyer, and many people on here are helping you. But you just aren't getting it.

I would have refiled with alot better evidence instead of hoping an appeal does the trick.

Yes, I have read somewhere it used to be 99.5% or higher but now the standard is raised to 99.99% or higher for immigration purposes.

Point remains OP is trolling. Is it one friend that got denied? or two friends? Is it 99.96% or 99.9999999999996%? Because as you can see, it is a huge difference between the two percentages for DNA test purposes. One gets you denied, the other gets you approved.

OP is just giving baseless information to make people scared or overly concerned for no reason at all. No proof or anything. Just hearsay.

This link suggests 99.5% or higher is still accepted:

Hmm, but that link also says "DNA testing reliability has advanced to the industry-accepted standard of 99.5 percent" which makes me think it's outdated vs the other one. Anyway if it is a factual case it would be more enlightening if the OP mentioned if that rejection happened in the same situation as his, that is, originally not bothering to do the test and then trying to submit it late. In which case it's not the DNA itself that is the issue but the lackadaisical response to the RFE.
