On Oct 17 my I got a letter from uscis saying my I-485 was denied and I was given 33 days to appeal because uscis claim I didn’t respond to the RFE I got back in May. My lawyer mailed the requested evidences uscis asked for back in July but uscis claimed they didn’t get it. When I got the denial notice, my lawyer filed a service motion to reopen on Oct 26 without filing form I-290B but included a proof that the response to the RFE was mailed and sign for by the uscis official who received the mail. Two days ago my 1-485 status changed from Case was Denied to Response to USCIS’ Request for Evidence was Received. 

Please does this means my I-485 has been reopened or still denied?

Also, my 33days expires on Friday, assuming the case still remains denied despite the status change, can I be able to file a new I-485 without this affecting it.

I would say it means your case has been reopened.  You can call USCIS and a customer rep can help verify that.

 

Dont be afraid to contact them.  Sometimes they can be helpful and the online system is notoriously unreliable...so I would verify everything.  We found out our EAD/AP cases were approved a day after via a phone call. It still took a few days for the online status to update.
