Hello everyone i have a interesting question. I was told by someone who tried to do the ke1 visa fiancé that someone who has been divorced does not qualify for this sort of visa. Me i was divorced 1 year and a half ago in USA and my fiancee was divorced in Russia this past march his country of origin is Tunisian so he had to get divorced there as well bcz he registered his marriage papers there even though he only got married in Russia. Therefore his documentation for divorce in Tunisia just finalized last month.  Do you guys know if this will be a problem or do we still qualify for the K1 visa. We are both divorced now.  Thank you so much in advance to all that answers to my question 🤗

This is completely untrue. My now wife was divorced before we got married. All we had to do was provide proof that the divorce decree. Provide proof that both you and your fiancee's divorce's have been finalized and you should be fine. If you have any more questions, please feel free to ask here. That is what members are here for. There are many members who have been through the process and have first hand knowledge. 

 

If you have no red flags you should be able to go K-1 -> AOS -> ROC -> Citizenship without a lawyer. Do not waste the money.

Timeline

As long as you have a legal document stating that the marriage(s) has been dissolved, you can get a K1 visa.

 

Some countries have some pretty draconian marriage and divorce laws... the US is pretty easy.

There is no issue with doing a K1 wiith either side being divorced. I was divorced when I did the K1 for my wife and brought her here to the USA. As long as you both have valid papers showing that you are both divorced then you are fine.

My brother in law did a K1 for his Russian bride

divorced 4 times to USC's (this one i would have denied)

so, anyone saying this is completely false

you will note the instructions for the K1 (or CR1) say send divorce documents with the application and if it was not allowed ,  the instructions would say "if divorced, you do not qualify"

there is no such requirement for the k1 regarding that, only that you are legally able and willing to get married

Totally untrue.  You have to just disclose on the application that both of you were previously married, and need to inclode both divorce papers.

I know a winner who married his 3rd K1 a couple of years ago

I would have suggested denying at #2 but divorce definitely was not a factor in approval
