My wife (Rita) would like to change her last name to mine. Can we do this with our initial AOS? If so, how do we go about this?

Rita would like to begin work soon. Does she have to wait for AOS approval or can she submit work authorization documents earlier in the process?

Rita would like to begin work soon. Does she have to wait for AOS approval or can she submit work authorization documents earlier in the process?

She can use your last name by virtue of marrying you. When she applies for her SSN (if she hasn't already) then she must show them her marriage certificate to be able to have the SSN in her married name. With the AOS app yes you can apply in her married name. Submitting a certified copy of the marriage certificate will explain the name change.

She will have to wait for EAD which can be filed concurrently with your AOS package. EAD can only be applied for when applying for AOS, not before. Typically work authorisation takes rougly 90 days for approval.

Yes you can file for the EAD before you file for AOS, however EAD's take about 90 days to be issued, and if you apply for an EAD before AOS, the EAD would only be valid for the length of the I-94, which would basically be a waste of money( seeings as the I-94 for K-1's is 90 days), therefore, its much better to apply for the EAD at the same time as AOS or after....whichever suits you best.

On a K1? I know you can do this on a K3. How does one apply for EAD without filing AOS on a K1? Why would anyone advise a person to file EAD that will only be valid for the length of the I-94 when they will have to pay the EAD fee AGAIN?

Both flutter and Karen are correct.

Flutter is referring to the 'interim EAD'. Most K1's don't bother with this unless they happen to acquire it for free at the POE. It is valid for the duration of the K1.

Karen is referring to the one year EAD, which is filed with the AOS and at present costs $180. The form number is I-765.

In immigration, there are technical matters and there are practical ones. Filing documents with USCIS isn't cheap and it's about to get more expensive. Unless the intending immigrant has a job in hand when their feet hit US soil it serves little purpose to pursue short-term employment authorization. The employment authorization issued at POE or the EAD available before adjustment are of a limited lifespan. You are almost assured to have a 'gap' between the time the 'shortlived' employment authorization ends and the 'adjustment authorized' employement begins. You'll get varying opinions in this community as to whether or not you should stop working if you have this gap. Bottom line is (under present immigration law) as the spouse of a US citizen you won't be 'punished' for that gap, but your employer could be.

For practical purposes, K1's should plan for a period of unemployment. It was in our budget - hard to handle I know but them's the breaks.

Be careful with name changes, the russians are very weird about names being different when it comes to passports, if your wife has to renew her passport prior to citizenship(most do) not greencard, she cannot have a different last name. There is a lot of information particularly in the russian forum about this. Internal and International passports have to match and the only way to change the internal passport is in russia and it takes 4-6 months. My wife just had her international passport renewed and she is keeping her maiden name until we can get everything figured out. SSN in old name, all tax and other info in old name just to be safe until we can get the passports changed or until she applies for citizenship. My wife got the temp work authorization from her POE at JFK and while we were doing her biometrics we asked about extending this, since she is currently employed. Our answer was exactly what Rebeccajo stated which I highlighted. He added that it would be VERY unlikely that USCIS would go after an employer under these circumstances, although they could. So continuing to work is very much at the employers risk and discretion.
