i really wish i had an answer or suggestion for you. your case is a perfect example that shows the unfairness of this process and lack of communication between the gov't and petitioners. there is no reason why you should have to wait so long, especially without an explanation from csc. if there were things missing, forms filled out incorrectly, then you would be able to point to something but not knowing why and being seperated from your loved one is painful. i'm really sorry that you have been waiting so long.

You need a lawyer. Find one immediately and have him enter appearances in your case. I did a 129f alone and cause I needed a waiver, I didnt do it right and ended up messing up my whole case. I ended up getting married afterwards then came home to an approved 129f and lost 6 months of wait time. GET A LAWYER . I finally borrowed the money for one and he is moving at a pace that I couuld never do

A lawyer costs but it is worth it

I couldn't agree more with what the Jediknight said.

10 Months of waiting and not knowing anything is beyond horrible ... I'm really sorry for you both and it makes me feel bad for every tiny complaint I make about waiting. I have absolutely NOTHING to whine about.

Good luck ... (F)

I appreciate the feedback. Not fair in the least. I wish I could afford an attorney, but I can't. Not much i can do at this point. They haven't denied me or asked me for anything. I'm quite sure my forms are in order. Thanks for your concerns. I just came back from China this week for another visit with my wife. It is indeed difficult.

wow :( i am soooo sorry to hear that... i mean i feel bad complaining after 4 months of waiting...but i will keep you in my prayers and hopefully (inshAllah =with God's will) you will hear something soon as well as everyone who has been waiting!:) that seems odd to me since you filed at CSC and their processing date for cases is November 12, 2006...yet yours was filed in August...i would try calling them and using the RFE Line...contact your senators...or an attorney would be best...at this point if i were in your position i would do whatever it takes and i pray that they will approve it for you soon! :) take care

whatever it takes...or how my heart breaks...i will be right here waiting for you... 636.gif

A quick peak at the current processing time suggests "November 12, 2006" so the first step you should do is call CSC. Just a polite call inquiring about the case will be a good first start. If you don't get a satisfactory response, I would suggest getting your congress person or senator involved.

I've done all of the above. I have called USCIS numerous times, the people who answer the phone don't know anything, they can only tell you what you see on the website... they are purely 1st line people. I've made an infopass appointment... still nothing. They just say they are doing background checks,,, I'm a pretty simple person, no police record.

I did have a case before. I brought a woman from China on the K1 with no problem, but she left after 6 weeks and she subsquently said I abused her, which is not true in the least. She simply used me to come to the US. I reported her to ICE, but they never asked me a question on the matter. She is still in the States to my knowledge.

I have a senator and and a congressman involved, but nothing to date on my case.

I am not sure,

but would it make sense to file I-129F then?

It supposed to help if your NOA2 takes forever...

I hope it would not create a problem with some cross-security checks.

But then may be they just ignore your case and filing I-129F would make CSC look at it again?

Just speculations...

Good luck

I don't know if filing the I129f would make sense... I can't afford it to be truthful. Still, they have updated the case 2 times last month per the senators request and a request by me. They sent me and the senator letter saying they are performing background checks. I think they are simply playing God with my life

Well, there is a chance that filing I129F would be free for you after July, 30.

K3 would definitely cause higher fees later in the process (they say $1010 for AOS), but those fees would be pushed into the future for when your SO is ready to adjust from K3. If I understand correctly, K3 would allow her to work, hence your SO may be able to help you with the cost of the K3 route.

I would do it in your situation, pending that I would worry that this may cause "doubling and mutual interfering" of security checks.

I admire your courage and your calm under the pressure you are facing.
