Got laid off, can I claim unemployment? CR1 pending approval for green card.

Good morning All,

I have a question , I got laid of work and my employer informed me I can claim unemployment as they had no work. Now my question is, i heard people with my visa status cannot claim unemployment benefits or any benefit as it will hurt my green card pending application followed by naturalization process. Is that true? I had a CR1 visa applied for green card 3 months ago. And after green card it will be for us citizenship. My state is Virginia, so my question is will this affect my case?

One does not apply for a green card after receiving a CR1 Visa.   You are automatically granted resident status upon entry. 

 

Unemployment benefits are not a federal means tested benefit so there should be no issues

They pay unemployment insurance cost to the state that is considered your workplace base.   Does not matter if you are a road warrior.   Unless they consider your home the equivalent of your office location it is in their homebase

Understood, maryland it is. Not so favourable circumstances,  just got laid off paid hefty amount for new apartment furniture car etc as things picking up and I had my one foot set in. Now back to drawing board. This part sucks when you get laid off with no indication and being assured a month ago you will not be fired you are here for long term etc. Just venting it out so apologies...
