Not sure if it will “speed it up” but it would certainly be best as I don’t think he can receive his permanent green card until that’s filed so I would do that as soon as you can so you don’t have to wait for that to be processed for months after the I130’s already approved

You don’t file I485 if you’re doing consular processing as the I485 is only for adjusting status for those who are already arrived before in the US on a nonimmigrant visa wishing to obtain permanent residency (so like in the case of OhWow, someone on a work visa who got married to a US citizen and now wants to stay in the US with their US spouse)

  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

I filed online on 02.14.2020 and got he receipt number immediately. Received the NOA a week later and my I130 was sent to Nebraska.

Visa bulletin is current at the moment which allows you to file. In the past, or in the future when visa bulletin is not current, I-130 must be approved and a visa number available to file I-485. I assume that’s the reason for “conflicting” information.

We did - we didn't sign the I-130 because it was an electronic form, but after reading about how people received an early RFE requesting a signed form, I had my husband sign a physical copy of the one we downloaded after filing, scanned it, and uploaded that along with more photos and screenshots of social media stuff. They don't have to consider it, but if they send an RFE asking for these things, we can always indicate that we've sent them in. 

Oh really - you heard of more folks that received RFE for this? Until now I thought I was the only one haha

Only for adjustment of status of permanent resident, though, keep in mind 🤪 Since spouse of USC is always current there's never any need to wait for I130 approval before sending I485 for adjustment of status

No problem! Yep, there is an unlimited number of visas available for spouses of US citizens (so they are always "current"), so adjustment of status is able to be applied for right away, visa bulletin and "current" PDs only applies to visa categories in which there is a limited number per year (such as a spouse of a non-citizen permanent resident)

On the new myuscis portal where i filed, it only says request for evidence (not initial) and the RFE letter says that we shall hear from them within 60 days after we replied which I think indicates they'll work on it once I reply.

Hi! any news on the requirement of the signature on page 9 part 6a-b? im about to file my petition, is it safe to just include that part on my evidences?

no clue to be honest. I thought I have been the only person that received it so far, but is sounds like @CGs_Mother knows of more people that received this request

I started to apply online, I have all our documents ready and I had no way to fill in a required field for contact phone number. I have been living in Bali for over two years now and I have deactivated my U.S number. The online application doesn't allow any non U.S. numbers. So how do I go about this? I can skip it but I am afraid that when I finally get to the end I will have a problem. Any clue on this matter? Is the online version for US citizens filing for their spouse while living outside the USA???

Hey :) you could get yourself a US number via Skype call... that's what we did  ;)

I think the form gives you an error if you leave blank (if I remember correct). We have all put the current (today's) date.

Not correct, but it's a fairly new tool and for the convenience of online filing we can accept some minor flaws :) Good luck!
