Hi everyone! Does anyone here can share me some info or have the same experience as me who was a Permanent resident when I-130 was filed then upgraded it when becoming a US Citizen? will the timeline be faster or slower? i need some feedbacks! thanks!

12/07/2004... Marriage date

12/30/2004... I-130 sent as LPR

01/12/2005... I-130 NOA 1

01/22/2007... filed for Naturalization

04/04/2007... Naturalization Interview

06/05/2007... Oath ceremony, I-130 upgraded to IR/CR1 spouse of USC by phone and letter

06/11/2007... I-129F mailed out to Chicago address

06/18/2007... I-129F NOA1 received in mail

06/25/2007... I-129F forwarded to California Service Center

07/12/2007... I-130 approved, lawyer as choice of agent (37 days after the upgrade)

08/13/2007... IV bill and AOS fee generated

08/27/2007... IV bill and AOS fee mailed (next day delivery)

09/03/2007... IV bill and AOS fee entered into the system

09/27/2007... AOS and DS230 arrived in mail

10/03/2007... AOS and DS230 mailed to NVC

10/09/2007... DS230 entered to the system

10/19/2007... CASE COMPLETED!!!

10/29/2007... 129F/ K3 approved

11/08/2007... Packet 4 dated, sent to USEM

11/28/2007... Early Medical Day 1

who is petitioning for who? Is it for a spouse (since it's in CR/IR-1 part of the forum)?

I petitioned for my husband with my previous I-130 when I was a permanent resident, now I am a US Citizen so I can upgrade it for CR/IR-1. when I called USCIS to upgrade they did it over the phone and told me i will recive a letter in the next 30 days. is that the one that i need to send with I-129F or can I use my old NOA1 from the earlier I-130 since I am petitioning for the same person?

zakura02, check my signature...I went thru the same situatuin as yours...My I130 was filed last year by my hubby who was an LPR then..he became a naturalized citizen January 25th of this year...we upgraded the petition the next day both over the fone and sending a letter regarding the upgrade and the copy of my hubby's naturalization cert and our NOA1. Try calling after 3 weeks...2nd week of march my hubby received a letter asking him to fax his nat cert and a cover letter with the title REQUEST TO UPGRADE I130.the letter was dated feb 26, exactly a month after our request to upgrade...Our case was touched immediately after we faxed everything and was approved.

Of course, the case processing will be much faster...I hope things will be fine for u... = )

June 5, 2006 - Received by USCIS

June 20,2006 - I130 notice date

January 25, 2007 - Hubby became a naturalized citizen

January 26, 2007 - sent mail to upgrade from F2 to IR1 and also upgraded it over the fone (USCIS told him to wait for 45 days for I130 to be upgraded)

March 13-Received a letter from USCIS asking for a copy of naturalization cert plus a cover letter entitled I130 Request for Upgrade

March 20- faxed the papers

March 21- TOUCHED!!! finally after 9 months...

March 22- Approval notice

April 2 - Case received by NVC and was assigned a case #.

April 30 - DS3032 & AOS Fee Bill have been generated and sent out

May 2 - NVC accepted agent of of choice w/c was e-mailed the same day DS-3032 was generated

May 7 - IV Fee bill has been generated

May 15 - Both AOS and IV fee bills received in the mail.

May 16 - Mailed both bills to NVC via USPS (overnight)...

May 25 - NVC finished processing AOS fee payment.

May 28 - I-864 package was generated and mailed out

May 29 - NVC finished processing IV fee payment

June 4 - DS230 was generated

June 8 - I-864 package was received in the mail

June 13 - sent I864EZ to NVC

June 15 - DS230 received in the mail

June 20 - DS230 sent to NVC

June 25 - DS230 received by NVC...I864EZ completed

July 6 - CASE COMPLETE!

Aug 15 - INTERVIEW DATE! Approved!!!

Oct 2- it's time to leave...= ) = (

thanks chizza! i hope that the same thing will happen to our case too. i did call already to upgrade it but havent written out a letter of request yet. do you remember in what address should i send it? and did ur hubby filed a K3 or I-129f for you? is it a good idea? thanks and i appreciate all the info..

I think my hubby sent it to the USCIS address..check it on your NOA1.

we were supposed to file K3 but it turned out that our I130 got approved right away so we opted not to...

You may file K3 but you will never be sure if it will be approved quickly or not. Going through K3 route will eliminate the time an I130 normally takes in nvc. But you will never know if you are already done with nvc (I130) by the time ur K3 gets approved. Besides, you can also speed up your I130 process at nvc by using Jame's shortcut (but we are not using it by choice).

So for me, I don't think it will be a good idea for u at this point in time to file for K3...but it's all up to you...you can read posts here on VJ to learn more and make up your decision...
