Hello All

 

My I-130 recently got approved and I am preparing all the documents for NVC stage. I have few questions as follow that I need your helps to address as possible. Thanks in advance.

 

1. I am planning to fill income tax 2019 along with requesting ITIN for my wife which means it will take couple months to get my transcript. Hence I will not have it ready at NVC stage. There are two options that I can approach:

 i) Using 2018, 2017, and 2016 for I-864EZ then submit the new one 2019,2018,2017 at Consulate when I have 2019 transcript. I have question for this option is that 2016 income tax has total income (my ex-wife and myself income) on it. What number do I fill in I-864EZ for 2016? is it just my income or the total (my ex wife+ myself)?
ii) If I want to use 2019 income tax (2019,2018, and 2017), can I submit the copy of federal income tax for 2019 plus W2 instead of waiting tax transcript which can take another 2 months from the date of filing.

 

iii) Is option ii) better than option i)? The idea is i try to remove anything that related to my ex-wife and also 2016 income tax was not even 1/3 of any other years income tax.

 

2) Do I really need to submit the letter of employment? The issue is that my letter of employment only includes base salary per year plus some factor for annual bonus. It does not include quarterly bonus and reward cash. The letter of employment salary is about 30K lower than W2. It will be confusing for NVC/Consulate why it does not match. Also, how much do I make per year if Officer at Consulate asks my wife? W2 or from letter of employment?

 

3) Since my case will have few red flags, i am thinking to upload an additional evidences at NVC stage (more visits after I130 submitted, healthcare, and life insurances). Is it recommended to submit it at NVC or it does look suspicious to Officer?

at this stage the 2019 is not needed so need the 2018 -2016 (the exwife on the 2016 is not a big issue-u had to provide the divorce document)

as for the 2019 and ITIN,  file as soon as she is able to fill out the W7 but as for a couple of months ,  don't count on IRS being fast

took me till June to get his ITIN and for IRS to complete tax returns 

filed mine Feb 1st as soon as i had all my needed tax documents

pray interview is before the 15th of April (for your case) and the 2019 are not needed as 2018 will be adequate

 

I did the ITIN but another member here just added spouse without it and was able to claim her

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Thank you.

Note that the 2019 tax return is not due to be filed until April 15, 2020.  If it is too soon to get a transcript, the Consulate will know that and accept a complete copy of the tax return including W2 and 1099 forms, which are part of a complete tax return.

NVC requires/requests your MOST RECENT tax return/transcript.  This means 2018 ONLY.     NOT 3 years.    Also NVC prefers the transcript over the 1040.    

 

If you completed Form I-864, I-864A, or I-864EZ submit an IRS tax transcript from the most recent tax year, which NVC can process more efficiently than a copy of a tax return.  Alternatively, you may submit a copy of a tax return from the most recent tax year.

Thanks for clarifying. One last question is 2016 income tax section that I need to fill in I-864EZ, do i list just my income for that year or include total ( my ex wife and myself on that transcript)?

The form asks "My Total Income" (adjusted gross income)   I would use the numbers from your 2016 tax return relating to YOUR income as that is what the form asks for.

Incorrect.  Enter the number on line 22 of the tax return, or from a transcript, total income.  Adjusted gross income applies only if you filed a 1040EZ form.  Not though that for many people, total and adjusted gross may be the same number even when using the 1040 form.

 

In this kind of situation, I recommend sending in all three tax returns, so it become clear some of that 2016 income was not yours.
