My Husband Passes Away

Hello Guys, 

This is the saddest thing happen in my life. I just received a call from my sister in law in the states that my husband passes away last night. I supposed to be happy because we got our case number already few days ago.

 

Who has the same experience as mine? I feel incomplete losing your loves ones and you are not on their side. It is really devastating. I see him last Jun2019 and suddenly this happens due to colon cancer. I know my CR1 will be converted to widow visa. Aside from informing NVC about the death of my husband, what are the documents that I need to upload in nvc?

 

Btw, I am currently working and living here in Jeddah, KSA. In my previous post, I have problem coz they assign my case to my home country which is Philippines.

You will need a copy of his death certificate.  You will need a new sponsor for the I-864  I would think also. (your sister-in-law if she is can/will ?)

 

As for your case file being given a Philippines number, that would tend to indicate your case file will be shipped to Manila, if that happens you will need to put in a request with the embassy in Jeddah, KSA to have your case file transferred.

 

You have not completed the NVC processing?   You may still be able to get NVC to ship the case file to jeddah ... make sure to contact NVC on this.

Hi, I havent started anything yet. i just received the nvc case# two days ago. I have read in some forum, that it will be converted to widow visa and excepted for AOS. I hope someone in this forum can share their experience.

Im really sorry for your lost :( pls contact with NVC with your husband death certificate, they will provide you all info for expedite your case and you’re able to come ASAP to USA. You don’t need any financial support doc how far I know. Good luck and God bless you

Nope. OP will submit I-864W instead: https://www.uscis.gov/i-864w

https://www.nolo.com/legal-encyclopedia/free-books/fiance-marriage-visa-book/chapter14-15.html "Widows and widowers of U.S. citizens may, regardless of the duration of their marriage, self-petition for or continue with their application for U.S. residence, so long as they do so within the two years of the U.S. citizen's death and do not remarry. They will not need to submit an I-864 Affidavit of Support. Their approved Form I-360 will be sufficient proof of their exemption. If the deceased U.S. citizen filed an I-130 visa petition before the death, it converts to an I-360 automatically, though the immigrant will need to advise USCIS of the death first." OP would contact NVC and provide a copy of the death certificate.

Thank you so much for this information. It is really helpful that I am not lost in the process. We have already case number and our case still at nvc. I just received the case number last week and this things happen. It is really painful that I cannot imagine at all. 

 

Soon when I have death certificate I can continue this journey. thanks once again.
